Why Should a New York Contractor Use BGES Group? Jerry Seinfeld and Larry David Have Some Thoughts…”

1. “You want to avoid drama? Go with BGES.”

Jerry would say, “Do you want your insurance claims to be like a Seinfeld episode? Full of misunderstandings, confusion, and people yelling at each other? No! You want BGES to handle it, so it’s smooth, no sitcom-level problems!”

2. “BGES won’t leave you hanging like George Costanza’s career!”

Larry would point out that unlike George’s never-ending search for stability, BGES Group gives you rock-solid insurance coverage without the constant failure.

3. “Using BGES Group is like finding a great bagel place in the city. You stick with it!”

Jerry would insist that once you experience the unbeatable service at BGES, you won’t want to switch to any other insurance agency. Like a great bagel, it’s rare and worth holding onto.

4. “BGES Group doesn’t need ‘sponge-worthy’ clients—they take care of all contractors!”

Larry would joke, “Elaine had to pick and choose who was sponge-worthy, but BGES Group? They don’t make you prove you’re worthy of coverage. You’re in! And fully protected.”

5. “BGES will cover your business like George covers his bald spot—only better.”

Jerry would remind you that BGES won’t leave gaps in your coverage like George leaves gaps in his excuses.

Why Women Fall in Love with Their Contractors: 10 Reasons Behind the Magic

It’s a story that feels straight out of a sitcom. Remember when Larry David’s wife left him for their contractor? Poor Larry! Sure, it was just a plotline in “Curb Your Enthusiasm”, but it got us thinking: What is it about contractors that has women falling head over heels for them? And why did Larry’s wife ditch him for the allure of sawdust and blueprints, not to mention Jeff, Susie and Leon?

As a Tri-State contractor, you might be laughing at the idea, but you might also be nodding along. Let’s dive into the fun reasons why women fall in love with their contractors—maybe it’ll offer some insights, or at the very least, give you something to smile about.

1. They Get Things Done

There’s nothing more attractive than someone who gets results. Contractors come in, assess the situation, and start fixing problems that have been bugging homeowners for years. It’s not just the completion of a job that’s swoon-worthy, it’s the can-do attitude that gets things moving.

2. They Bring the Vision to Life

Contractors have the power to turn a house into a dream home. For many women, seeing a contractor bring their ideas to life, whether it’s a new kitchen or a remodeled bathroom, is like watching an artist at work. It’s hard not to be captivated by someone who transforms dreams into reality.

3. They’re Problem Solvers

The sink is leaking, the walls need repair, and there’s that mystery draft by the window—contractors have the answers. This problem-solving superpower makes them incredibly appealing. Who doesn’t love someone who can fix things when they go wrong?

4. They Take Control

For some, there’s something undeniably attractive about a person who takes charge. Contractors are leaders, organizing teams, managing projects, and making sure everything runs smoothly. That kind of confidence can sweep anyone off their feet.

5. They’re Skilled with Their Hands

Let’s face it: there’s something inherently attractive about someone who can work with their hands. Contractors are masters of their craft, whether it’s swinging a hammer, laying tile, or building a deck. Skill, precision, and a hands-on approach have a certain charm.

6. They Understand the Importance of Communication

Good contractors know how to listen and communicate with their clients. They listen to what homeowners want, offer suggestions, and keep the lines of communication open throughout the project. This understanding and partnership often creates a bond of trust—and sometimes, affection.

7. They Have a Plan

Contractors don’t just walk in without a plan. They’ve got a timeline, they know what needs to be done, and they’ve already mapped out the best way to achieve it. For many women, a man with a plan is simply irresistible.

8. They Work Hard

There’s a certain appeal to watching someone who works tirelessly to complete a job. Contractors spend long hours on site, ensuring that every detail is perfect. Their work ethic and dedication are often admired and respected, and sometimes, that admiration turns into something more.

9. They Transform Spaces—And People’s Lives

Contractors don’t just remodel homes; they remodel lives. When a woman sees her home being transformed from ordinary to extraordinary, it’s easy to feel a sense of gratitude and connection with the person responsible for that change. And sometimes, that connection sparks something deeper.

10. They’re Confident in Their Abilities

Confidence is always attractive, and contractors are often brimming with it. They know their craft, they’ve got the experience, and they’re not afraid to tackle even the toughest jobs. A man who knows what he’s doing and isn’t afraid to take on a challenge? That’s a recipe for admiration.

So, while Larry David may have seen his wife run off with the contractor, maybe it wasn’t all that surprising. Contractors have the skills, confidence, and charm that make them hard to resist!

Understanding Key Elements of New York Contractor General Liability Policies: Additional Insured, Waiver of Subrogation, and Primary & Non-Contributory Forms – Made Easy To Understand

In the complex world of New York construction insurance, contractors often face a maze of requirements to ensure they’re adequately protected. Key among these requirements are the additional insured endorsements, waiver of subrogation clauses, and primary and non-contributory endorsements. These elements can be both advantageous and challenging, depending on the specifics of the construction project and the contractual agreements in place. In this article, we’ll break down the positives and negatives of these critical components and explore how they can impact your general liability coverage.

Additional Insured Endorsements: Pros and Cons

1. Ongoing Operations Coverage

CG 20 10 4/13: This endorsement provides coverage for the additional insured (AI) during the contractor’s ongoing operations. The specific project must be listed, and coverage applies only while the contractor is actively working on the project.

  Positives:

  – Project-Specific: Ensures coverage is directly tied to the listed project, which can prevent misunderstandings.

  – Focused Coverage: Limits coverage to the period of active work, reducing the insurer’s risk and potentially lowering costs.

  Negatives:

  – Limited Duration: Once the work is completed, this endorsement no longer provides coverage, leaving the AI potentially exposed to claims arising after project completion.

CG 20 33 4/13: Similar to the CG 20 10, this endorsement automatically grants AI status when required by a written contract, provided there’s privity of contract.

  Positives:

  – Automatic Coverage: AI status is automatically applied, ensuring seamless coverage without additional paperwork.

  – Contractual Privity: Ensures that only parties directly involved in the contract are covered.

  Negatives:

  – Ongoing Operations Only: Like CG 20 10, coverage is limited to the contractor’s active work on the project, with no protection post-completion.

CG 20 38 4/13: This endorsement extends coverage to parties referred to in the construction agreement who are not in direct contractual privity with the contractor.

  Positives:

  – Broad Coverage: Extends protection to a wider array of stakeholders, which can be advantageous for complex projects involving multiple parties.

  – No Privity Required: Allows coverage for entities without a direct contract, offering greater flexibility.

  Negatives:

  – Ongoing Operations Only: Coverage is again limited to the period of active work, with no post-completion protection.

2. Completed Operations Coverage

CG 20 37 4/13: This endorsement is designed for completed operations, extending coverage after the contractor’s work is finished.

  Positives:

  – Extended Protection: Ensures that the AI has coverage for claims arising after project completion, which is crucial for long-term protection.

  – Project-Specific: Tied to specific projects, reducing ambiguity in coverage.

  Negatives:

  – Post-Completion Only: This form does not provide coverage during the contractor’s active work on the project, necessitating additional endorsements for full protection.

CG 20 39 12/19 and CG 20 40 12/19: These endorsements offer automatic coverage for completed operations when required by a written contract. The CG 20 40 is broader, covering parties without direct privity.

  Positives:

  – Automatic Status: Simplifies the process by automatically applying coverage as required.

  – Broader Protection (CG 20 40): Covers more stakeholders, making it ideal for large-scale projects with many involved parties.

  Negatives:

  – Professional Services Exclusion: Both endorsements exclude claims arising from professional services, such as architectural or engineering activities. This could leave certain stakeholders unprotected.

Waiver of Subrogation: Balancing Protection and Risk

CG 24 04 Waiver of Transfer of Rights of Recovery Against Others to Us: The 2019 version of this waiver endorsement eliminates ambiguity from previous versions and broadens the scope of the waiver to a wider set of policies.

  Positives:

  – Broad Application: Expands the waiver’s scope beyond just CGL and PCO coverage parts, offering more comprehensive protection.

  – Clarified Language: The updated language reduces confusion and ensures that the waiver applies even without direct contractual privity.

  Negatives:

  – Limited by Insured’s Own Waiver: The waiver is conditioned on the insured’s own waiver of claims prior to the loss, potentially narrowing the scope of protection.

CG 24 53 Automatic Waiver: This form automatically applies the waiver of subrogation, simplifying the process for contractors and insurers alike.

  Positives:

  – Automatic Application: Reduces administrative burden by applying the waiver without additional steps.

  – Equivalent Protection: Offers the same protection as CG 24 04 but with the ease of automatic inclusion.

  Negatives:

  – Potential Overreach: Automatic waivers may apply in situations where the insured might prefer to retain subrogation rights, potentially increasing risk.

Primary and Non-Contributory Endorsements: Expanding Coverage

CG 20 01 Primary and Non-Contributory Endorsement: This endorsement has been revised to include coverage for liquor liability, extending its applicability.

  Positives:

  – Broader Coverage: The inclusion of liquor liability makes this endorsement more versatile, protecting contractors in a wider range of scenarios.

  – Priority of Coverage: Ensures that the contractor’s policy is primary, reducing the likelihood of disputes with other insurers.

  Negatives:

  – Complexity in Claims: The broader application can lead to more complex claims handling, particularly in industries where liquor liability is a significant concern.

Conclusion

Navigating the intricacies of general liability policies for New York contractors requires a deep understanding of the various endorsements available, including additional insured, waiver of subrogation, and primary and non-contributory forms. Each has its own set of advantages and potential drawbacks, depending on the specifics of your project and contractual agreements.

EEOC Issues Construction Industry Harassment Prevention Guidance

The Equal Employment Opportunity Commission has issued new guidance for preventing harassment on construction industry worksites.

The guidance, while not binding, can be used as a template for construction firms to implement anti-harassment policies. According to the EEOC, the industry has an especially high incidence of harassment complaints, and “some of the most egregious incidents of harassment investigated by the EEOC have arisen in the construction industry.”

The nature of the construction industry includes risk factors that may increase the likelihood of harassment, including workforces that are primarily male, those where there is pressure to conform to traditional stereotypes, and decentralized workplaces, according to the EEOC.

These factors may be exacerbated by the presence of multiple employers on a worksite, and the cyclical, project-based nature of construction.

The guidance, “Promising Practices for Preventing Harassment in the Construction Industry,”  outlines the main principles for implementing an effective strategy to prevent workplace harassment, as follows:

Buy-in from leadership

Worksite leaders, from the project owner to crew leads to union stewards, should clearly, frequently and unequivocally message and demonstrate that harassment is prohibited.

The EEOC recommends that project owners and general contractors prioritize and emphasize  worksite-wide collaboration to prevent and correct harassment. The general contractor is typically well positioned to coordinate harassment prevention across a worksite and serve as a backstop for resolving difficult issues

General contractors should assist subcontractors and staffing agencies with their legal obligations under federal anti-discrimination laws by referring them to the EEOC’s Small Business Resource Center.

It also recommends that project owners or sponsors consider requiring that contract bids include a plan to prevent and address workplace harassment.

Strong and comprehensive harassment policies

Policies should include:

  • A clear description of prohibited conduct, with examples tailored to the work environment, such as taunting tradeswomen when they are performing a difficult or dangerous task, or vandalizing the toolboxes or personal protective equipment of Black workers.
  • An unequivocal statement that harassment is prohibited.
  • A description of complaint and reporting processes, and where to find more information about them.
  • A commitment that the employer will provide a prompt, impartial and thorough investigation, and that it will keep confidential the identity of individuals who make reports.
  • A statement that workers are encouraged to report harassment, bullying or other inappropriate conduct even if they are not sure if the conduct violates the policy.
  • A discipline policy that is prompt, consistent and proportionate to the severity of the harassment or related misconduct, such as retaliation.
  • An unequivocal statement that retaliation for reporting harassment is prohibited.
  • Account for language barriers in the workforce, such as for non-native English speakers or workers with poor literacy.

Policies should also include steps for when a subcontractor lacks the experience or resources to resolve an issue, takes inadequate steps to address or prevent harassment or fails to take reasonable corrective action in response to harassment.

In such instances, a general contractor should consider facilitating and assisting subcontractors in finding solutions, especially when harassment is occurring between workers from different employers.

Regular and effective training

All workers should be regularly trained on the harassment policy and complaint system.

Training should be:

  • Clear, easy to understand and offered in languages commonly used by onsite workers;
  • Tailored to the specific workforce and work environment; and
  • Interactive, if feasible. Alternative options include providing training through an interactive module accessible via mobile phone or watching a series of short video clips, followed by a guided discussion about the clips.

The takeaway

While the guidance isn’t legally binding, employers should consider following its recommendations as doing so can reduce the risk of liability.

Are You a Tri-State Business Owner Whose Workers’ Compensation Insurance Policy Is Being Cancelled? Turn to BGES Group for Help!

If you’re a Tri-State business owner facing the cancellation of your workers’ compensation insurance policy, you’re likely feeling the pressure of finding a new provider—fast. Whether it’s due to loss experience, your insurance company no longer covering your class of business (like contractors), or other reasons, you need a solution that’s both effective and reliable. BGES Group is here to help. As workers’ compensation insurance specialists, BGES Group has a proven track record of stepping in when others step away.

Common Reasons for Workers’ Compensation Policy Cancellations

1. Loss Experience: If your business has experienced significant claims, your workers’ compensation insurance provider may choose to cancel your policy. This often leaves companies scrambling to find new coverage under challenging circumstances.

2. Class of Business No Longer Covered: Insurance companies sometimes stop covering specific business classes —like contractors —leaving business owners without a viable option. This can be particularly frustrating for those in high-risk industries where coverage is essential.

3. State Coverage Withdrawal: Some insurance companies decide to pull out of certain states altogether, leaving businesses in those regions without coverage. If your current provider is no longer offering workers’ compensation insurance in your state, it’s crucial to find a replacement as soon as possible.

4. Audit Issues: If your company hasn’t completed the necessary audits, your insurance carrier may choose not to renew your policy. Non-renewal due to audit issues happen regularly, leaving you in a precarious position.

5. High Experience Modification Factor: A high experience modification rate (EMR) can make it nearly impossible to renew your workers’ compensation policy with your current provider. This factor indicates a higher risk of workplace injuries, making you less attractive to insurers.

Why BGES Group Should Be Your First Call

BGES Group is a leading expert in workers’ compensation insurance with a deep understanding of the challenges businesses face when policies are canceled or non-renewed. They have a history of helping companies with difficult insurance needs find effective solutions, even when other agencies have turned them away. BGES Group specializes in securing workers’ compensation insurance for businesses across various industries, including those with high-risk classifications especially contractors.

When you work with BGES Group, you’re partnering with a company that understands the nuances of the workers’ compensation insurance market. How Your Business Can Survive a Hurricane

A hurricane can grind a business’s operations to a halt, possibly for a long period of time. But if weather forecasts warn that a hurricane is approaching, there are steps you can take to prepare and recover.

You’ll have to plan for both windstorm damage as well as possible flooding as claims for the latter continue to grow as storm surges grow increasingly higher due to climate change and rising sea levels.

Fortunately, you can take the following steps to minimize losses, soften the financial impact, and enable operations to resume quickly.

Make sure employees are safe — If a hurricane is imminent, workers belong with their families, either at home or evacuated to a safe location. Showing genuine concern for employee safety is the right thing to do, promotes good workplace morale, and helps ensure that your workforce will be available when you resume operations.

Collect employees’ cell phone numbers and personal e-mail addresses so you can keep each other informed.

Know your insurance coverage — The business may need to make claims against its property and auto insurance after a hurricane. It is important to review policies to make sure the business has bought enough coverage to replace buildings, furniture and equipment. Increases should be requested, if necessary.

Be aware that flood insurance policies typically have a 30-day waiting period before they provide coverage, so this coverage will not help if it is purchased the day before a hurricane arrives. Keep contact information for insurance agents and companies handy in case you have to submit claims.

Protect property and vehicles — To the extent feasible, cover windows and move vulnerable property and vehicles to safe locations. Back up electronic data and ensure that the copies are stored offsite in servers far from the hurricane zone.

Unplug electronic equipment if possible to avoid damaging power surges. Test emergency backup power generators to protect temperature-sensitive stock such as food and medicine. Keep emergency first responder phone numbers handy.

Monitor the storm’s progress — The media will cover the storm non-stop, so stay informed. Do not attempt to travel to the business location until local authorities announce that it is safe to do so.

Protect property from further damage after the storm — If safe to do so, cover broken windows and damaged roofs; pump out standing water; use fans to start drying out water-damaged flooring; remove perishable stock to alternate locations; and protect or move electronic equipment.

Many business property insurance policies will pay to offset some of the cost of protective measures.

Communicate with employees — It is important that they know about when work will resume.

Contact insurance providers immediately to report damage — Cooperate with them fully during the claim process.

Document losses — Take photos or videos of the damage. If available, use drones to record videos of roof damage. Create written descriptions of damaged property. Gather receipts and other documents to establish the age and replacement cost of property.

Collect information to support business-income insurance claims, including past and projected sales records, payroll records, invoices for necessary continuing services such as fuel supplies, and business expense records. Obtain repair estimates on damaged vehicles.

The takeaway

Hurricanes are devastating events for businesses. Around 75% of organizations that lack a continuity plan will fail within three years of a natural disaster.

But it does not have to be that way. With advance planning and thoughtful action afterward, a business can survive a hurricane.

What Business Insurance Policies Cover Rioting, Looting

Protests and mass demonstrations that can sometimes descend into rioting and civil unrest are becoming more common not just in the U.S., but all over the world. Businesses can sometimes unwittingly become collateral damage from vandalism and looting.

It doesn’t have to be a retail establishment; office buildings and other commercial properties can also face looting and damage during civil unrest. For business owners whose properties are damaged or destroyed, the ordeal can be both unsettling and stressful as they wrestle with the specifics of filing insurance claims.

Fortunately, you don’t need special insurance policies to cover these events. Your basic commercial property policy and commercial auto (if you have business vehicles that are damaged) will usually suffice.

Here’s a look at what your policies may cover and how to prepare for filing a claim if your business is damaged during rioting or civil unrest.

Property damage

Standard commercial property policies cover damage to a business property caused by fire, explosion, riot or civil commotion, vandalism or malicious mischief. This would include coverage to the structure, as well as any inventory, fixtures and other contents. Business owner’s policies also include this risk.

Damage payouts would be subject to sublimits (specific or blanket) for inventory, fixtures and other items, as well as the policy deductible.

Commercial vehicle damage

For business-owned vehicles to be covered for damage for these types of events, you’ll want to ensure that you have purchased comprehensive coverage, which is an optional, but highly recommended part of your policy.

Comprehensive coverage may cover a vehicle if it is:

  • Stolen,
  • Damaged, or
  • Destroyed.

One of the most common damages to vehicles during riots is broken windshields, which you can usually get covered with an optional glass coverage rider.

Business interruption coverage

Companies that are forced to close as a result of rioting and looting damage may have coverage for business interruption under a business property policy.

Business interruption insurance may cover lost income if a company is unable to operate after its premises were damaged during a riot or social unrest. Coverage may also apply if a business suffers a loss of income because of curfews or if authorities bar access to a property.

Coverage is typically triggered if there is direct physical damage to the premises.

Filing a claim

When filing a claim, read your policy or give us a call to determine how to best present it. It’s important to understand the policy’s limits and deductibles before spending time documenting losses that may not be covered.

If you are going to file a claim, document all damage. Keep receipts for all your inventory and fixtures.

In the event of a claim:

  • Take photos of all damage.
  • Contact your agent and file a claim immediately.
  • Clean up to protect your building, but do not make major repairs until you talk to the insurance company.
  • Keep receipts for any remediation work.

If you’re going to file a business interruption insurance claim, you will need:

  • Pre-riot financial statements and income tax returns.
  • Post-riot business records.
  • Copies of current utility bills, employee wage and benefit statements, and other records showing continuing operating expenses.
  • Receipts for building materials, a portable generator and other supplies needed for immediate repairs or remediation.
  • Paid invoices from contractors, security personnel, media outlets and other service providers.
  • Receipts for rental payments, if you move your business to a temporary location.

Note: Many policies require a 72-hour waiting period before a policyholder can begin making a business interruption claim. That’s because the first three days of business shutdown, access constraints or limited hours of operation because of a civil authority action, are often excluded from coverage.

There may also be a limit to the claim period. A standard limit is up to three weeks of losses.

Understanding NYCPAP Credit and Payroll Cap in Workers’ Compensation Insurance for New York Contractors

When it comes to workers’ compensation insurance for New York contractors, two key terms often come into play: NYCPAP Credit and Payroll Cap. While they both relate to how workers’ compensation premiums are calculated, they serve different purposes and can have a significant impact on your insurance costs. Understanding the difference between these two can help you better manage your workers’ compensation expenses and ensure you’re getting the best value from your insurance policy.

NYCPAP Credit: What Is It?

The New York Construction Premium Adjustment Program (NYCPAP) Credit is designed to help contractors who pay higher wages by providing a credit that reduces their workers’ compensation insurance premiums. The idea behind the program is that contractors who pay higher wages are likely hiring more experienced, and therefore safer, workers, which reduces the likelihood of workplace injuries.

To qualify for the NYCPAP Credit, your company’s average hourly wage must meet or exceed a threshold set by the New York Compensation Insurance Rating Board (NYCIRB). The threshold is adjusted annually, so it’s essential to stay updated on the current requirements.

How NYCPAP Credit Works:

1. Eligibility: To be eligible for the credit, you must report your employees’ total wages and hours worked on a quarterly basis. If your average wage meets the NYCIRB threshold, you will qualify for the credit.

2. Credit Application: The credit is then applied directly to your workers’ compensation premium. The higher your wages, the larger your potential credit, which can lead to significant savings on your premium.

3. Calculation: The exact credit amount is determined based on a sliding scale that compares your average hourly wage to the threshold. The closer your wages are to the upper end of the scale, the greater the credit.

Payroll Cap: What Is It?

The Payroll Cap, on the other hand, refers to the maximum amount of payroll that can be used when calculating workers’ compensation premiums for specific high-wage employees, typically in executive and trades roles. The purpose of the payroll cap is to prevent excessively high workers’ compensation premiums for employers who pay substantial salaries.

In New York, the payroll used to calculate premiums is capped for these higher-earning employees. This means that no matter how high the actual payroll is, only a portion up to the cap is used in premium calculations. This cap is also set by the NYCIRB and may vary depending on the classification code.

How Payroll Cap Works:

1. Applicability: The payroll cap primarily applies to executive officers and certain other high-wage trades employees. It is not applicable to all employees, making it particularly relevant for companies with a few key individuals earning significantly higher salaries.

2. Calculation: When calculating workers’ compensation premiums, the insurer will apply the payroll cap to the eligible employees’ payroll. For example, if the payroll cap is $1,500 per week, and an trades employee earns $2,500 per week, only $1,500 of that payroll will be used in the premium calculation.

3. Impact on Premiums: The payroll cap helps to lower the workers’ compensation premiums for businesses with high-wage earners by limiting the amount of payroll considered in the premium calculation.

NYCPAP Credit vs. Payroll Cap: Key Differences

While both the NYCPAP Credit and Payroll Cap influence workers’ compensation premiums, they operate in different ways:

NYCPAP Credit: This credit reduces the overall premium for contractors who pay higher-than-average wages. It’s designed to reward companies that likely employ more experienced workers by lowering their insurance costs.

Payroll Cap: This cap limits the payroll amount used to calculate premiums for high-wage earners, thus preventing excessive premiums for companies with a small number of high-earning employees.

In essence, the NYCPAP Credit is an incentive for paying higher wages across the board, while the Payroll Cap is a protective measure to prevent overly inflated premiums due to a few high salaries.

How Do They Work Together?

For New York contractors, both the NYCPAP Credit and the Payroll Cap can be utilized to manage workers’ compensation insurance costs effectively. By qualifying for the NYCPAP Credit, you can reduce your overall premium, while the Payroll Cap can ensure that the wages of high-earning employees do not disproportionately impact your insurance costs.

It’s important to work closely with your insurance broker to ensure that both the NYCPAP Credit and Payroll Cap are correctly applied to your policy. Misunderstanding or overlooking these elements can result in higher premiums than necessary.
