Are you looking for a NEW Worker’s Compensation Company with “Great Pricing,” “The Right Coverage,” Great Expert Advice” and Great Service?”

We Represent 25+ Companies.  We can help any New York, New Jersey and Connecticut Business Owner Better Their Workers Comp Situation!

Know Your Workers’ Compensation Options…We Provide Expert Advice So You Make The Right Choice!

Many business owners think the only option for their Workers’ Compensation Insurance is through a state or assigned risk plan.  Many are not aware of the other choices they have when it comes to buying this coverage.

Let’s start with insurance companies that offer stand-a-lone, Workers Comp Policies.  Usually their rates are guaranteed for one year.  Businesses pay a fixed, monthly premium. To bind coverage usually a 25% deposit is required.  This deposit is required to be paid each policy year.  Depending on company, they may offer a pay-as-you go payment plan.  This is the main type of Workmans Comp policy business owners purchase.

Another option, which few business owners know about, is a company that offers a payroll/workers’ compensation plan.  This plan, around for 24+ years, has several features designed to help auto services, contractors, limousine services, moving & storage agents and local truckers and their employees.  Note this is the ONLY program we know that’s been in existence 24+ years (it offers long-term coverage stability which we feel is important), the payroll company owns their workers compensation company.  This allows them to insure riskier classes of business such as the ones mentioned above. This company has a separate division which allows them to offer all types of Contractors Insurance like Commercial General Liability, Commercial Umbrella Liability and Business Auto Policies.

There are other payroll companies offering Workers Compensation Insurance.  They have agreements with insurance companies and payment for coverage is usually deducted weekly or bi-weekly.  Most of their companies are conservative with the types of businesses they’ll insure.  If you fall into a low risk category like a florist or electrician, they’ll have no problem insuring you.  Some of their companies offer competitive rates.  With others, their rates can be high.  Some payroll services add fees on top of what they get paid from their insurance companies.  BUYER BEWARE!

Finally, if you have poor loss experience and a high experience modification, making it difficult to get insurance, there are Professional Employer Organizations (PEO) that may come to your rescue!  They couple payroll service with workers compensation. They are like payroll/wc plans but technically/legally are set up differently.  One technicality is they are considered co-employers.  This means they have say over who you hire.  Some plans offer the option to purchase affordable health insurance. This is another way to “Skin a Cat” if you need Group Health Insurance.  Rates are competitive.  Provider networks extensive.

Options When You Have These Problems

Depending on the work you do, you may be able to get quotes from several insurance companies or just one.  For example, if you’re an accountant’s office, florist, plumber or electrician, most carriers will offer you workers compensation coverage.  However, if you’re a limousine service, trucker or high-risk class contractor, only one or two carriers may offer coverage.

What if you have poor loss experience?  Usually you have to go to a state or assigned risk plan.  But what if you don’t want to go through one?  What if you previously had coverage with your state’s plan, got cancelled and owe them money?  Usually, unless you pay off balance they won’t sell you a new policy. What if because of poor loss experience their rates are astronomical?  What can YOU do?

Many businesses turn to BGES Group for help.  Recently, we helped two contractors, each with over one million in losses, get coverage.  Of course, the worst claims were from employees who no one witnessed getting injured, who immediately hired attorneys, who filed their claims NOT through their employer but directly with the Workers’ Compensation Board, one filing their claim 10 months after date of supposed accident.  These people have no conscious nor idea how they jeopardize their employer’s existence and co-workers livelihoods!  Because we have “The Right Companies for Businesses with Poor Loss Experience,” we got them coverage!  One employer, now every time an employee gets injured, hires a private investigator to investigate claim.  Within hours, private investigator is looking into what happened. This investigator is quite shrewd.  Are you a New York City employer whose having claim problems?  Want to hire this P.I.?  Call Gary Wallach at 914-806-5853 and get help.

What if you are about to be cancelled due to an audit dispute?  A lot of businesses come to us for help when they’re having audit problems.  Even though their audit is wrong, their company leaves them with two options, pay or be cancelled.  Usually, the amounts owed are not just a few dollars but thousands, tens of thousands of dollars.  One employer can’t get a new policy until they agree to pay off balance company says they owe, $41,000!  Only after they sign an iron clad, written agreement drawn up by this insurance company’s attorneys can they purchase new coverage. The only issue for the owner is he doesn’t owe them money….the company may even owe him money. Having audit problems and worried about being cancelled? Call 914-806-5853 and get a “Plan B” in place now.

Work out of state?  For example, you are a New York City contractor insured through state plan.  Most of your jobs are in the 5 boroughs but from time to time, you take jobs in New Jersey.  These jobs last a few weeks to several months. For these jobs, you use employees who live in New Jersey. What happens if an employee gets hurt and seeks medical care in New Jersey?  Think you have the right coverage?  Think again?  It’s our opinion if an injury occurs, example worker falls and suffers severe back injuries, you will be responsible for hundreds of thousands of dollars because your insurance carrier will deny coverage.  So many contractors are clueless about this issue.  BUYER BEWARE!

Recently we helped a New York office based contractor, who does all their work in Connecticut, get “The Right Coverage.”  They have workers that live in New York and Connecticut.  However, all their work is done in Connecticut.  We cannot believe their insurance broker and insurance company did not catch this mistake and advise them to purchase coverage with a company that covers both New York and Connecticut.  One bad claim and they could have been on the hook for hundreds of thousands of dollars!  They are out of danger because we got them “The Right Coverage.”  We are looking into getting their money back from this carrier.  We are talking about over $100,000!  Think this can’t be done?  Have this problem contact us!

How To Get Help So Your Problem Gets Fixed

What can you do when faced with a problem that has your back against the wall?  We feel calling BGES Group is one of your best bets!  The owner, Mr. Wallach, is one of the most helpful “Workers’ Compensation Specialists” in the New York and surrounding areas.  He is an encyclopedia of knowledge and will help you until your problem gets fixed!

One amazing thing about Gary Wallach is when you call him you immediately get him.  When you email him he emails you right back.  When you text him he texts you right back.  When you ask for help he has an unlimited capacity to give.  Certificates are issued within minutes. You never wait for anything!   He doesn’t charge ridiculous policy fees of up to $10,000 or service fees of up to 10%!  Why his competitors do this to their clients when they get paid from their insurance companies, in his opinion, shows what really drives them.  High-risk businesses like contractors pay through the nose for their insurance, why make it any more painful.  Whether a client or not, Mr. Wallach helps everyone!  He’s the “Diamond in the Rough” that every once in a “Blue Moon” you get to work with.  If Gary can’t help he will direct you to someone he thinks can!  His phone number is 914-806-5853 so call him anytime you need help.

BGES Group can help with the following issues:

  1. Your Business Is In a High Risk Category Therefore Hard To Find Worker’s Compensation – We have up to 25 companies to market your account to.  We have several carriers that can insure businesses with poor loss experience.  Several others to insure if you’re considered high risk.  For example, we can insure Asbestos Abatement, Demolition and Roofing contractors through non state plans.

  2. Audit disputes – We can help fix audit mistakes or find you a new company.

  3. Looking To Get Away From Annual Audits – Depending on the state and plan, we may be able to get you into a program that doesn’t do annual audits or if they are legally required to do so, they require minimal work and documents from you.

  4. Have Poor Loss Experience – If you are being cancelled, we can find you a new company.  If your rates have skyrocketed, we can find you a company whose rates are lower.  Two contractors, both with over $1 million in losses, came to us seeking help.  We ended up getting them new companies, both offering better rates.

  5. Being Cancelled – We can find you a new insurance company.

  6. High Experience Modification Factor – We have programs that have their own unique rating calculations so we may be able to get you lower rates.

  7. Payroll Being Misclassified – We can help you get reclassified so the proper class code (s) and rates apply.  In addition, we have a service that can go back up to seven years and get you refunds for the mistakes made in charging you.  Our service has gotten refunds of up to $500,000 for business owners.  See 8.

  8. Workers’ Compensation Premium Recovery – Get back up to $500,000 on past Workers Comp payments.  We can go back seven (7) years.  Because the rules are complex, based on ever-changing codes, insurance companies have little interest in finding mistakes and saving you money.  That’s where we come in. With years of experience in recovering excess and/or erroneous payments, we identify and recover premiums on your behalf. And we do so on a contingent-fee basis: you pay only if and when we collect on your behalf.  Examples of refunds: $50,000, $230,000, $300,000 and $500,000, $20,000.  We do all the work.  And YOU get money back you never even thought possible!

  9. Unhappy with Payroll Service Providing Your Workers Compensation – We have up to 10 programs and can get you lower payroll processing fees and lower Worker’s Compensation rates.

  10. Do Not Want To Pay a Fixed Premium Every Month – We have programs that allow you to report payroll weekly or monthly and pay premium based on payrolls reported.  For the months payroll is low, your premium will be low too.  This can help with cash flow.

  11. Do Not Want To Pay a Renewal Deposit Every Year – We have programs where you pay up front a deposit then on renewal, no deposit is required.

  12. Sick of Paying Your Broker a $500 to $2,500+ Policy Fee or up to a 10% Service Fee – Unless company does not pay us a commission we usually do not charge policy or service fees.  You work hard for your money.  We want you to keep as much as possible and this is our way of showing we are sincere.

Whatever your issue, we can help.  Just tell us what you want and we will find a way to get it done.  Let us take whatever headaches you have and make them our headaches.  For help call Gary Wallach at 914-806-5853.

With The State of The Economy Murky, Here’s How To Protect Yourself Against Fraudulent Workers Compensation Claims

For 42 years we’ve watched clients go from having clean workers compensation claim records to having hundreds of thousands, millions of dollars in claims that make it near impossible to get them affordable coverage.
About Some of The Claims:
1.  A lot of the larger claims happened soon after the person came to work.
2.  Some happened where no one saw the employee get injured.
3.  Some were filed directly with the Workers Compensation Board months after the supposed incident.  Then the WCB notified the employer who of course knew nothing about the injury because they were never notified.
4.  For all these claims, the injured employee used an attorney.
Below we have listed several articles we feel can be helpful to your business.  If you need help implementing any of the ideas, feel free to call Gary Wallach at 914-806-5853.

Prevent Workers’ Comp Claims by Keeping the Flu at Bay

The federal Centers for Disease Control and Prevention has estimated that between 1.8 and 5.7 million people in the U.S. contracted the H1N1 virus between April and July 2009. While many of them may have picked up the virus from contact with family and friends, it is very likely that many became infected at their workplaces. Infected workers may not have realized they had the virus, or they went to work despite feeling sick. Exposure to communicable illnesses is a common occurrence at the workplace. If an employee becomes ill, misses work, and requires medical treatment, does the employer have to provide her with workers’ compensation benefits?

Workers’ compensation laws require employers to pay benefits to workers who suffer injuries or illnesses that arise out of their employment. It may be relatively easy to determine that a particular injury arose from someone’s employment. For example, a carpenter who slips and falls off a ladder while installing walls in a new home is clearly on the job; Workers’ compensation should cover the costs resulting from the injury. Illnesses, especially viral illnesses like influenza, can be more difficult for investigators to trace. A worker who gets sick may have contracted the virus at work, at the gym, on the subway, or any number of places.

According to the International Risk Management Institute, insurance investigators and physicians must answer several questions about an individual’s illness to determine whether it is work-related.

  • Is the relationship of the illness to the exposure at work logical and plausible?
  • Was the dose of the viral agent to which the person was exposed large enough to cause the illness?
  • Are the person’s signs, symptoms, and test results characteristic of what a person with the illness would have?
  • Where exactly did the person come into contact with the viral agent?
  • Could the person possibly have been exposed to the viral agent outside of the workplace?
  • Does all the evidence establish that the person’s exposure to a viral agent at work caused his illness?

People may be exposed to H1N1 and other flu strains in dozens of places, only some of which are work-related. Employers must evaluate the facts of a particular case when deciding whether or not to contest a workers’ compensation claim for work-related illness. If the employee’s duties kept him solely within the office and no other employees showed any flu-like symptoms, the employer may successfully contest the claim. However, if other employees gave signs of having the flu or the worker regularly has physical contact with vendors or customers who might have exposed him, the worker’s claim may be successful.

To reduce the chances of a successful occupational illness claim, employers should:

  • Encourage employees to get vaccinations each year as the flu season approaches.
  • Foster a work environment where employees who feel ill can stay home from work without fear of negative consequences.
  • Where practical, allow telecommuting for employees with flu-like symptoms but who still want to work.
  • Provide hand sanitizers for employees and visitors to use.
  • Provide employees with educational material about H1N1 and other flu strains.
  • If an employee becomes ill while at work, segregate him from the other employees until he can go home. Require him to take precautions, such as covering his nose and mouth, if he must visit common areas of the workplace.

Businesses should also consider creating a plan for dealing with a pandemic, should it occur. Visit www.flu.gov to find information on how to write the plan and for other resources on managing flu risks. People spend much of their waking hours in the workplace. Businesses therefore play an important role in keeping them healthy and safe. With planning and common sense precautions, businesses can stay productive and healthy during flu season.

Workers Compensation Flu

Back Injuries Plague Workforce

Injuries sustained in the workplace present problematic issues for both the employer as well as the injured employee. Of the many types of work-related injuries, back injuries are the most commonly reported malady to workers’ compensation carriers.

A back injury can cost a company thousands of dollars due to such incidents. Missed work for doctor appointments and recovery time account for a large majority of financial losses that may occur.

Types of Work-Related Back Injuries

The most common type of back injury complaint is that of the lower back. Nearly 1,000,000 employees per year in the United States alone have reported lost work days due to lower back injury. Spine ailments such as strains or sprained muscles account for a great number of disability claims, especially in the field of construction and manual labor. The greater the physical demand of the work, the higher the rate of back injuries.

While the pain and suffering of the worker who experiences a back injury may seem obvious, the employer must be left to deal with the pains of financial loss due to the absence of the employee as well as the workers’ compensation costs. Neither party benefits in any way from an injury of such magnitude. In short, both sides are faced with long-term issues related to the back injury. Back Injury Prevention in the Workforce

While the effects of job-related back injuries are readily known, the causes and how to prevent such injuries should take center stage for both employers and employees. Many companies offer in-house training and courses to help educate management and workers on how to avoid back injuries. A common program found in many companies is an injury prevention course that promotes safe work habits such as:

  • Proper lifting procedures
  • Maximum weight guidelines
  • Training on lifting equipment such as dollies and carts
  • Proper access to storage equipment to promote easier lifting

Another preventative measure that may facilitate back injury prevention is a company incentive program for workers. Through these types of programs, the worker is offered a bonus for safety and injury-free work. Not only do programs such as these benefit the worker, the employer will ultimately deal less with the problems related to back injuries by implementing such programs.

Aside from the ill effects and prevention ideas presented, employers would do well to also avoid taking a disbelieving stance in response to an employee who may have sustained a back injury. While it is possible to feign such an injury, most workers who claim to have acquired an injury are not attempting to deceive their employer. Proper steps must continue to be taken to ensure the health and welfare of both the company and its workers.

Break the Cycle of Workplace Accidents with Effective Accident Investigations

You’ve heard the old adage about people not learning from history being doomed to repeat it? This is certainly applicable to the safety programs of businesses. If accidents are to be avoided, the business must learn how and why they happen in the first place. It’s only through this knowledge that businesses can prevent alike accidents from reoccurring.

An accident investigation should be devised in a manner that will thoroughly and objectively gather information, not assign blame and carelessly point fingers. Accidents are rarely the result of one solitary causative agent. In fact, they generally involve a multitude of direct and indirect factors that result in human failure, mechanical failure, and/or poor work environment. Once a thorough investigation is completed, the business should effectively be able to develop new training and safety protocols to prevent the same incident from happening again. Here are ten tips to assist you in thoroughly conducting an investigation into an accident:

  1. Always make sure any injured individuals receive appropriate first aid treatment and medical care.
  2. Don’t disturb the area where the accident took place.
  3. Secure the accident area.
  4. Ensure the site is safe before beginning an investigation, but begin the investigation as soon as it is safe to do so to make sure that evidence hasn’t been disturbed and the incident is fresh on the minds of witnesses.
  5. The safety program should define employee protocol for dealing with an accident site.
  6. The safety program should also have an investigation guideline and checklist to ensure proper protocol adherence.
  7. Materials needed to conduct an investigation should be readily available – camera, video recorder, personal protective equipment, notepads, pens and markers, accident and incident forms, checklists, measuring tape, evidence containers, and so forth. These should be used to thoroughly document the site of the accident, gather and record information, and preserve evidence.
  8. All witnesses should be documented immediately and interviewed as soon after the accident as possible.
  9. Anyone that used the equipment involved or that was near the accident scene just before or after the accident should also be documented immediately and interviewed as soon as possible.
  10. Objective questions should be asked in a manner that will give a comprehensive snapshot of the accident, events leading up to the accident, and the conditions of the environment surrounding the accident. This should include supervisory instruction, equipment condition, work protocol, weather conditions, and such.

Don’t Let Shabby Incident Investigations Leave You Vulnerable

Employers should always make it a top priority to provide workers with a safe working environment. That said, accidents can still happen, even when employers strictly enforce safety practices and employees strictly adhere to them. Incidents happen due to a breakdown, departure, or failure in the acceptable method of performance. When an accident does unfortunately occur, the incident investigation report will serve in several important objectives. So, it’s vital that a timely and thorough incident investigation takes place.

The Purpose Of Incident Investigation

The main purpose of an incident investigation is for the employer to learn why the breakdown happened and determine procedures that could be put into place to prevent it from reoccurring. The employer should gather and examine the data they collect to figure out where and why the departure from acceptable behavior happened. Employers can learn from errors and increase future productivity from knowing if there was any indication of the breakdown prior to it occurring, or if there was any possible point that the breakdown could have been interrupted and stopped.

Legal liability is another purpose of investigating the incident. During the investigation, the employer will gather information that could be paramount in mounting a possible defense against any resulting lawsuit(s). The defense team in such lawsuits will build their strategy based on the what, when, who, where, why, and how of the incident, data that’s often revealed during the incident investigation.

How Should The Investigative Process Take Place?

The investigative process will begin as the scene of the incident is reviewed and examined. This can provide an exact reason, or possible scenarios, as to why the incident happened. Pictures should be taken of the incident scene. The pictures can later be compared to blueprints, diagrams, or drawings of the area to help determine what chain of events led up to the incident occurring.

Now, it’s time to question all witnesses that may have information leading up to, during, or just after the incident. You can use forms created by regulatory agencies or internally created forms to guide the questioning process. Either way, using the completion of the form as a format for the questions asked will help to maintain objective questioning of witnesses, no matter who is asking or being asked the questions. It’s human nature for most people to immediately form assumptions and theories following the incident. Keep in mind that this type of non-factual information is useless and adds nothing to the validity of the investigation.

_____________________________________________________________________

All the gathered information will be carefully analyzed by the investigator to determine what elements are explainable and what elements still need an explanation. The chronology of the chain of events will be explored. Then, the actions of those involved are looked at along side concurrently occurring actions to see if any of the concurrently occurring actions had any bearing on the incident.

Following the analysis, the investigator will make a written report that contains a description of the incident, the circumstances and elements that led to the incident occurring, why the incident occurred, and any recommendations to prevent it from reoccurring. The report should accompany the physical documentation collected by the investigator.

While an incident investigation is initially about investigating, it makes little sense to know the what, how, and such of the incident if nothing is done to prevent it from reoccurring. So, the last stage of the incident investigation is about implementing the recommended changes suggested in the final report. For optimal success during the implementation stage, the employer should assign a task force to ensure that the recommendations are put into place, supported from the top down, and are subsequently followed by everyone.

Controlling Workers’ Compensation Costs Takes a Multi-Faceted Approach

Business owners from all industries know that they have controllable costs and fixed costs. Owners hold on to their financial books with clasped hands and hope for the best outcome when it comes to fixed costs. However, owners can proactively work on getting control over their controllable costs, but it does take an effort. One such controllable cost that business owners can work on is workers’ compensation.

You’ll need to start by understanding that managing your worker compensation expenses won’t involve a one-step solution, but rather a multi-faceted approach to the overall issue.

Begin before the claim is filed. You might have heard that an ounce of prevention is worth a pound of cure or a stitch in time saves nine, meaning that it’s easier to forestall a problem now than fix the results once it happens. Nothing is truer when it comes to managing and containing controllable costs. If you want to control your workers’ compensation costs, then you must develop a systematic procedure for reporting, monitoring, and correcting workplace behaviors that are considered unsafe. It’s important that these procedures are a priority for all your employees, not just a responsibility held by your management team.

An analysis should be done to determine the potential risks of a given job, such as musculoskeletal issues created by a workstation design being ergonomically incorrect or injuries caused by repetitive stress or movements. Of course, the workers actually performing the job are ideal choices to be directly involved in such an analysis. Do keep in mind that this analysis will only be as effective as the method used to collect the findings. The analysis should be done in a structured setting and at a designated time. It should include your senior management, first-line supervisors, and a set number of representatives from the department staff. The participants should be presented with a problem and given sufficient time to brainstorm for potential solutions to the problem. At the conclusion of the meeting, the staff should be told when they will be notified of what and when the chosen solution(s) will be implemented. In the meantime, you can use feasibility studies to help you determine which solutions will be most workable and practical for your business. In order to ensure that quality improvements are continuous and have the greatest impact on your workers’ compensation numbers, these brainstorming meetings will need to be a regularly ongoing practice.

_____________________________________________________________________

New employees should undergo safety training and existing employees should undergo refresher safety training. Some employers tend to skimp on refresher training, but just keep in mind that it’s often the seasoned workers that have performed the same job over and over for an extended period of time that feel most comfortable taking the shortcuts that create safety hazards. During your safety training, you might also consider adding some of the most common unsafe practices seen in your industry and actually hold a demonstration as to why they should never be part of an employee’s work practices.

A return-to-work program should also be in place so that employees with a claim can stay connected to their workplace; be apprised of the employee memos, newsletters, and bulletins; and return to work ready to go.

In closing, part of your multi-faceted approach to controlling workers’ compensation should also include an annual assessment of your workers’ compensation package and the carrier. You should know what the fees paid are for the benefits provided and what the cost to operate is in comparison. Research what various carriers are currently offering and do a comparison against what you already have in place to see if there are any cost savings available from changing carriers.

Slash Workers’ Comp Losses by Using Pre-Employment Screening

According to the U.S. Bureau of Labor Statistics, around a third of all workers’ compensation claims are filed by employees only on the job for a year or less, with 13% being filed by an employee in their first three months of employment.

You can evaluate the statistics as they relate to your own company’s claims by sorting your employees into two categories – those employed longer than one year and those employed less than a year. Once all your employees have been sorted into the two groups, you can determine the frequency of claims per 100 employees from each group. If a large section of your workforce is aging and working physically demanding jobs, then you may find that your long-term employee group may have more claims. However, most employees will find that it’s their shorter-term employees that have the higher claim frequency.

It’s the lack of experience and training that’s one of the main culprits behind shorter-term employees having a higher claim frequency. The good news is that as they get more work hours under their belt and receive additional classroom and/or on-the-job training, they will gain experience and knowledge about safety hazards and become more safety conscious as they perform their job tasks.

Another factor causing new hires to be more prone to accidents is their personality traits and habits. Some workers may have a personality that leaves them with a tendency to ignore the rules. Other workers may simply believe that they should be left to their own devices if they get their work done on time. There are also certain employees that are prone to using short cuts. Maybe it’s in their nature, or maybe from habit, but either way they do it without regard to the risks involved.

As far as personality factors go, one of the best solutions will be to pre-screen applicants so that you can help avoid hiring someone that doesn’t demonstrate habits and personality traits conducive to your ideal working environment. The two types of pre-screening tests are: behavioral assessments and personality measures.

Behavioral assessments will ask an applicant extremely direct questions, such as about personal drug use and theft. It’s easy to mistakenly assume that the applicant would just lie and answer the question as it should be answered. However, behavioral assessment questions are so blunt that the applicant is often caught not paying attention and will automatically answer the questions honestly without even thinking about it or realizing they’re admitting to a bad behavior. The behavioral assessment will allow you to know the exact nature of the risk the applicant poses.

_____________________________________________________________________

Personality tests will examine an applicant’s personal characteristics, attitude, and opinions. The questions are much more indirect than a behavioral assessment. The responses can help you evaluate and rank various job applicants based on the possible risks they pose.

In closing, using both tests together can be a very potent risk control tool. Employers that utilize such pre-screening tests also find that they can save significantly from both better avoiding hiring an applicant that’s not very likely to stick with the job -and- from potentially reducing their number of workers’ compensation claims.

Are You Doing All You Can when it Comes to Workers’ Compensation?

Is everything possible being done to protect your company from the costly impacts of workers’ compensation claims? As an employer, you know that injuries will happen. However, this doesn’t mean you shouldn’t try to prevent them by knowing the dynamics and some of the solutions recommended by the experts.

Minor Injury, Major Claim

It’s the small injuries that often result in big claims. Some statistics show that 80% of workplace injuries are inconsequential, meaning they just require first aid or a trip to a physician. Eight percent of such claims are sprains and strains to the neck, back and various joints. However, these types of injuries account for an estimated 80%-90% of the system’s costs. Major claims are likely to follow if the frequency of such seemingly inconsequential injuries isn’t addressed.

Falsified/Exaggerated Claims

Claims that didn’t actually occur or that occurred outside the workplace are only representative of a small fraction of claims. However, employers can implement tip lines, video surveillance, drug screenings both before employment and after accidents, and so forth to reduce false claims:

The larger problem is from exaggerated injuries. Employers can take these steps to address exaggerated claims:

* Get injured employees immediate and appropriate treatment.
* Even if duties need to be temporarily modified, get injured employees back to work as quick as possible.
* Ensure supervisors communicate with injured employees and convey their concern and support.
* Do as much as possible to reduce the disruption employees may face post-injury.
* Assess and address behavioral issues that could be driving an injured employee’s disability.

Observing Patterns

Experts have recognized that there are patterns of reoccurring claims within groups, such as among certain industries or particular groups of employees. For example, more injuries may be seen in equipment operators that don’t receive proper eye screenings.

Overweight employees tend to have more injuries than those of an average weight. The healing of injuries may be longer and more difficult among diabetic employees.

Overexertion, meaning doing too much; too fast; and/or too frequently, is one of the primary causes of sprain and strain injuries. This often comes from an employee demanding more of their body than it’s capable of doing. The challenge is that this is a human behavior. Studies have shown that the majority of workplace injuries are from unsafe acts, not unsafe conditions. In other words, even in the absence of workplace hazards, injuries will happen.

Additionally, there are also patterns of reoccurring fraudulent and exaggerated claims, such as an employee that seems to repeatedly have accidents.

_____________________________________________________________________

Claim Reduction

Begin at the hiring process, ensuring that potential employees are capable of doing the physical and mental demands you’ve listed in the applicable job description. It’s important to understand that injury prevention must be embraced at the leadership level to be effective. Statistics show employees are most likely to have injuries when they feel their management doesn’t care. You may also consider:

* Excellent workplace safety programs.
* Efficient communication programs that allow you, injured employees, and insurance adjusters to easily communicate.
* A post-injury protocol, specifying the immediate reporting of an injury to appropriate personnel.
* Routing injured employees to seek medical care from a provider specializing in occupational injuries.
* Staying in touch with both the injured employee and their medical provider, making sure that you communicate your concern and care to the employee as they recover and accommodate any physical restriction recommended by the provider upon their return.

Cost Mitigation

Employers can take several routes to reduce the financial impact of claims. Transitional duty programs that enable an injured employee to continue some capacity of working as they recover would be one example. Research shows that around 40% of employers don’t currently have a transitional duty program.

Another example would be referencing treatment guidelines to determine typical recovery times for various injuries. This information can be used to approximate how long it should take an injured employee to be treated and recover.

Employers may consider having an on-site clinic for employees to go for both acute injuries and everyday health issues.

Partnering with a physical therapy network may be a consideration. Research has shown that companies affiliated with physical therapy networks see injured employees returning to full-duty work 30% faster.

Wellness, Don’t Be Afraid

Lastly, some employers are apprehensive about implementing wellness programs because they’re concerned that participation itself may cause injuries. However, the risk of such is far outweighed by the many benefits of a wellness program, including claim-related benefits like healing faster and being able to resume work sooner. Remember, the success of any program comes from it being accepted from the top down.
