Protecting Your Firm as an Additional Insured

In the course of doing business, you may sometimes find yourself entering into contracts requiring that your business be named as an additional insured on another party’s insurance policies.

This is often done to make sure that your own insurance is not depleted by defense and indemnification costs for losses for which you may be legally liable as a result of the business relationship you have with the other party, and that are not due to your own firm’s direct negligence.

An additional insured is defined as an individual or entity that is not automatically included as an insured under the policy of another, but for whom the named insured’s policy provides a certain degree of protection.

When to opt for additional insured statusThere are many instances when you may want your firm included as an additional insured on another’s policy. Here are just a few examples:

  • If you are a building owner, you want to be an additional insured on the property and general liability insurance of your tenants in case one of them damages your building or in the event that a visitor to the property is injured.
  • If you are the owner or a contractor on a construction project, you want to be an additional insured on the general liability insurance of your contractors and subcontractors in case there is an injury to one of their employees.
  • If you are a distributor or a retailer, you may want to be an additional insured on the insurance programs of the manufacturers of the products that you sell.
  • If a contractor comes onto your property to perform work of any type, including erecting displays or other maintenance or structural work, you will want to be named as an additional insured on their policy in case the display falls on someone, or someone is injured due to the work they are performing. You don’t want to be held responsible for any dangers or injuries created by the contractor’s work.

If you are to become an additional insured on another company’s policy, you need to confirm that the other party has indeed named your company as an additional insured with its insurance company. Their word alone is not good enough.

You should demand a copy of the policy that explicitly lists your company as such. You want to see a copy of the policy and not the certificate of insurance, which is not sufficient proof that your company has been added.

Additional insured status is effectively conferred through an additional insured endorsement to the other party’s original insurance policy. An endorsement essentially serves as an amendment to the terms of an insurance policy that is incorporated into the relevant insurance policy.

These amendments can take the form of an endorsement that specifically names a particular additional insured, or a general endorsement that identifies some class of parties as additional insureds.

But, if there is ever a dispute about your company’s status as an additional insured, you will want to have in hand not only the other party’s certificate of insurance, but also a copy of the policy itself and the endorsement that makes your company an additional insured.

Ensuring your status is properly secured

There are a few best practices that you can implement to help make certain your firm’s status as an additional insured has been properly secured:

  • At a minimum, always insist on receiving a copy of the relevant additional insured endorsement, as this is the instrument that establishes additional insured status;
  • An additional insured endorsement does not, however, state an insurance policy’s terms and conditions. In order to avoid being surprised by unexpected policy terms (such as strict notice requirement or unfavorable notice of cancellation provisions), you should ask for and receive a copy of the entire insurance policy under which you are an additional insured, and be sure to read it; and
  • Retain additional insured endorsements and the relevant insurance policies for as long as there is any potential that claims triggering those policies might be made.

Maximizing Insurance Coverage and Savings for New York Contractors: Why BGES Group is the Solution

In the bustling New York construction industry, contractors face numerous challenges and risks on a daily basis. Ensuring comprehensive insurance coverage is one of the most crucial aspects of protecting their business interests. That’s where BGES Group comes in, offering a unique and invaluable service that sets them apart from the competition. In this writing, we’ll explore why contractors operating in the New York area should consider allowing BGES Group to conduct a free comprehensive review of their insurance coverage and get a second opinion to ensure they’re getting the best value for their money.

**Tailored Coverage for New York Contractors: General and Umbrella Liability Insurance**

BGES Group is well-acquainted with the nuances of the New York construction landscape. With their network of 50 contractor specific insurance companies, they offer contractors access to general and umbrella liability insurance companies specifically tailored to the needs of New York contractors. This specialized focus can result in significant savings, with some contractors enjoying savings of up to 50 percent or more on their insurance premiums.

**Tailored Premium Structures**

The rising costs of materials are a constant concern for contractors. Having liability premiums based solely on gross receipts can exacerbate this financial strain. BGES Group offers insurance policies with premiums calculated based on payroll and subcontracted costs. This tailored approach provides a fairer and more sustainable premium structure, particularly in times of economic volatility.

**Uncovering Exclusions and Restrictions**

One of the most valuable services BGES Group provides is their ability to pinpoint exclusions or restrictions that contractors’ agents might overlook. Often, insurance agents fail to mention or contractors forget critical details that could prove detrimental at the time of a claim. BGES Group’s comprehensive review process brings these potential pitfalls to light, giving contractors the opportunity to address them before they become an issue.

**Forewarned is Forearmed**

Imagine discovering a Labor Law exclusion buried within your insurance policy after a claim has been filed. This scenario is not uncommon, and BGES Group has encountered it several times. By availing their free review, contractors can rest assured that they are fully informed about the content of their policies and can avoid unpleasant surprises during claims.

**Navigating Customized Insurance Forms**

Modern insurance policies often feature customized forms and wordings. Without a clear understanding of these nuances, contractors may face challenges when submitting claims. BGES Group’s specialization in insuring New York contractors allows them to provide clarity and guidance on policy wordings, ensuring that contractors are fully informed about their coverage.

**Specialized Expertise in Contractor Programs**

Many insurance agents are generalists who may not possess the specialized knowledge required to represent the best insurance programs for contractors. BGES Group, on the other hand, has cultivated a network of 50 companies specifically designed to market insurance programs tailored to contractors. This specialization ensures contractors have access to the most advantageous insurance options available.

**Subcontractor Coverage: A Crucial Consideration**

In the complex world of contractors’ insurance, the importance of ensuring that subcontractors carry proper insurance cannot be overstated. BGES Group recognizes the significance of this aspect and can guide contractors in ensuring that subcontractors’ coverage aligns with their needs. Failure to do so could lead to a claim being declined due to the wording of liability policies.

**Adapting to Changes in Workers Compensation**

The landscape of workers’ compensation insurance for contractors is constantly evolving. As carriers withdraw from the market, contractors may find themselves facing coverage gaps. BGES Group is uniquely positioned to offer programs that most agents lack access to, ensuring contractors have coverage even when faced with cancellations due to changes in the market or other reasons.

**Unparalleled Service and Support**

Beyond their expertise and comprehensive insurance offerings, BGES Group prides itself on its exceptional service. When contractors reach out for assistance, they can count on timely and knowledgeable responses. This level of commitment ensures that contractors have the support they need, precisely when they need it.

In conclusion, BGES Group’s services go far beyond typical insurance agency offerings. Their focus on New York contractors and their specialized expertise within the industry make them an invaluable partner for any contractor looking to optimize their insurance coverage and protect their business interests. With the potential for substantial savings, comprehensive coverage, and a deep understanding of the complexities of contractor insurance, BGES Group is the partner contractors can trust to secure their future success.

BGES Group: A Guide for New York Contractors on Choosing Between Pollution Liability and Professional E & O Insurance

Contractors in New York face numerous challenges while carrying out their projects, and some of these challenges involve potential liabilities and risks. Two crucial insurance coverages that can safeguard contractors are Pollution Liability Insurance and Professional Errors & Omissions (E & O) Insurance. The BGES Group, a leading insurance agency, can assist New York contractors in making informed decisions about which coverage best suits their specific needs. In this article, we will delve into the details of each coverage, their scope, and provide real-life examples of scenarios where contractors would benefit from such insurances.

1. Pollution Liability Insurance:

Pollution Liability Insurance, also known as Environmental Liability Insurance, is designed to protect contractors from damages resulting from pollution incidents. These incidents can involve the release of contaminants into the environment, causing harm to people, property, or the natural ecosystem. This coverage is especially relevant for contractors involved in projects that have a significant environmental impact, such as construction, demolition, waste management, or hazardous materials handling.

Coverage Scope:

– Clean-up costs: Covers expenses associated with the cleanup and removal of pollutants from the site.

– Third-party claims: Protects contractors from legal liabilities if third parties, such as nearby residents or businesses, file lawsuits due to pollution-related damages.

– Legal defense costs: Assists in covering legal expenses arising from pollution-related lawsuits.

Example Scenario:

Suppose a construction company working on a project in New York accidentally ruptures an underground oil tank, leading to a significant oil spill. The pollution contaminates a nearby river, causing damage to the ecosystem and impacting nearby properties. Pollution Liability Insurance would cover the costs of cleaning up the spill, potential third-party claims for damages, and legal defense fees during the ensuing lawsuits.

2. Professional Errors & Omissions (E & O) Insurance:

Professional E & O Insurance, also known as Professional Liability Insurance, protects contractors against claims of negligence, errors, or omissions in their professional services or advice. This coverage is crucial for contractors who provide specialized services and advice to clients, as even minor mistakes or misunderstandings can lead to costly lawsuits.

Coverage Scope:

– Professional negligence: Protects contractors against claims of failing to meet professional standards or breaching the duty of care.

– Legal defense costs: Covers expenses related to defending against claims, whether valid or frivolous.

– Financial damages: Provides coverage for financial losses incurred by clients due to the contractor’s errors or omissions.

Example Scenario:

A New York architectural firm is hired to design a commercial building, but they make a critical miscalculation in the structural design. As a result, the building’s foundation is unstable, leading to potential safety hazards and costly repairs. Professional E & O Insurance would cover the legal costs incurred while defending against the client’s claims and any financial damages awarded to the client.

Determining the Need for Each Coverage:

1. Pollution Liability Insurance:

– Projects involving hazardous materials handling or storage, such as asbestos removal or chemical storage, require this coverage to protect against potential environmental accidents.

– Contractors working near bodies of water, wetlands, or environmentally sensitive areas should consider this coverage due to the higher risk of pollution incidents.

2. Professional E & O Insurance:

– Contractors offering professional services, such as architects, engineers, or consultants, should obtain this coverage to safeguard against claims arising from errors or omissions in their work.

– Contractors who provide advice or recommendations to clients, such as project managers or consultants, should also consider this coverage to mitigate potential legal risks.

Conclusion:

Choosing the right insurance coverage is essential for New York contractors to protect themselves against potential liabilities and risks. The BGES Group offers comprehensive guidance to contractors, helping them determine whether they need Pollution Liability Insurance or Professional E & O Insurance. By understanding the scope and examples of each coverage, contractors can make informed decisions that align with their specific project requirements and professional services. With the right insurance in place, contractors can focus on delivering successful projects while safeguarding their reputation and financial well-being.

New York Contractors – The Ugly Truth Insurance Agencies Don’t Want You to Know About Their Servicing of Your Account!

Insurance agencies play a vital role in protecting New York contractors and their businesses from potential risks and liabilities. However, behind the scenes, there are certain inconvenient truths that many insurance agencies would prefer to keep hidden from their clients. In this writing, we will delve into ten ugly truths that expose the less favorable aspects of insurance agencies’ operations and why contractors should consider working with BGES Group who are construction insurance experts and right all wrongs other agencies make.

1. Constant Employee Turnover:

One of the first hidden truths is the high turnover rate among insurance agency employees. Frequent turnover can lead to inconsistent service and a lack of familiarity with contractors’ specific needs. It can also affect the continuity of relationships, making it challenging for clients to build rapport and trust.

2. Lack of Knowledge Regarding Contractors’ Operations and Coverage Needs:

Insurance agencies often lack in-depth knowledge about the intricacies of contractors’ businesses. This limited understanding can result in inappropriate coverage recommendations, leaving contractors vulnerable to potential risks that are not adequately addressed in their policies.

3. Poorly Trained Customer Service Personnel:

Contractors may encounter customer service personnel who are inadequately trained to handle their specific queries and concerns. This deficiency in training can lead to inefficiencies in the claims process and leave clients feeling frustrated and neglected.

4. Limited Understanding of Policy Coverage, Exclusions, Restrictions, Conditions, and Warranties:

Insurance policies can be complex, and some agencies may not thoroughly comprehend the various coverage aspects, exclusions, restrictions, conditions, and warranties. This lack of understanding could result in contractors being unaware of critical coverage gaps until it’s too late.

5. Automatic Policy Renewals Without Proper Market Assessment:

Insurance agencies often automatically renew contractors’ policies with the same companies year after year without exploring other options. This practice may cause clients to miss out on better coverage or lower rates available elsewhere.

6. Absence of Coverage Recommendations:

Customer service personnel at some insurance agencies rarely offer proactive coverage recommendations to contractors. This could mean contractors are unaware of additional coverage that may better protect their businesses.

7. Overwhelmed Customer Service Personnel:

With hundreds of accounts to manage, customer service personnel at certain insurance agencies may be swamped with daily servicing, leaving them with insufficient time to give individual accounts the attention they deserve.

8. Extra Ridiculous Policy and Service Fees:

Some insurance agencies may impose excessive policy and service fees, which are often detached from the actual workload involved in servicing an account. Usually a fee is added on to each policy serviced which we feel is ridiculous because the agency is getting paid a commission from each insurance company.      These additional costs add up to thousands, tens of thousands of dollars and place an unnecessary financial burden on contractors.

9. Inaccessibility of Key Personnel:

Clients may experience frustration when trying to reach their designated contacts at the insurance agency. They may encounter delays due to employees being away from their desks, out to lunch, in meetings, or on vacation.

10. Delayed Response Times:

In conjunction with the above issue, contractors may have to wait hours or even days to receive a response from their insurance agency, leading to potential delays in critical decision-making.

The BGES Group Difference:

 1. Personalized Attention:

3. Constantly On Top of Your Account:

With a limited number of accounts to handle (most agencies have their account executives servicing 120-200 accounts, BGES Group has their account executive servicing 50 or less), the dedicated professional at BGES Group ensures that they stay abreast of all the developments related to your insurance. This proactive approach ensures that your account is always well-managed and your needs are addressed promptly.

This commitment to keeping costs in check can lead to substantial savings, potentially saving clients thousands, or even tens of thousands of dollars.
