Vacant Buildings Pose Risks, Insurance Challenges

Office and commercial building vacancies have exploded since the COVID-19 pandemic hit, leaving many buildings completely empty of tenants or partially occupied.

According to the website Statista.com, the average vacancy rate for offices nationwide in the first quarter of 2022 was 12.3%, which is an improvement from 17.4% in the first quarter of 2021.

Unfortunately, when buildings stand vacant they become susceptible to a variety of problems. Vacant properties receive little or no maintenance, attention or security. This can lead to costly problems and loss of insurance coverage.

The dangers

There are roughly 31,000 fires in vacant buildings annually, resulting in dozens of deaths, hundreds of firefighter injuries, and an average $642 million in property damage.

When vacant buildings receive little or no attention or security, it can lead to problems such as:

  • They become a target for vandals. Vacant buildings can wind up with broken windows and graffiti-covered walls.

  • Fixtures and materials inside the building, such as copper piping, may attract thieves.

  • They can become convenient hangouts for young people or shelters for the homeless; they also can become centers of criminal activity, such as drug-dealing.

  • Trespassers smoking on the premises, decayed wiring, arson, and production of illegal drugs like methamphetamines may cause fires in vacant buildings. In addition, automatic sprinkler systems may be shut off, allowing fires to spread, and lack of security prevents early detection.

  • Toxic substances remaining on the premises may leak and contaminate soil and groundwater.

Insurance implications

If a building is actively occupied and someone conducts business there, the risks of vandalism and what insurers term “malicious mischief” against that property are relatively low. But if nothing is going on in the building, then it’s an invitation for vandalism and malicious mischief.

In response, property insurance policies typically state that if a building is vacant or unoccupied for a certain period — typically 30 or 60 days — then the policy won’t cover certain losses, such as damage done to the building by vandalism and malicious mischief. In some cases, the policy may be cancelled if it’s vacant for a certain period of time.

If you are faced with the possibility that one of your properties is going to suddenly be vacant, you should take a look at your property insurance policy to see if it has a vacancy exclusion and if so, what it says. Some levels of vacancy may be acceptable in some policies.

If the building will stay vacant or unoccupied, you should notify the insurance carrier. That notice will probably lead to a repricing of the coverage, but the insurer may also change or cancel the coverage.

For example, if a building is largely vacant, the standard commercial property insurance policy reduces loss payments by 15% for most causes of loss and will not cover some specific losses, such as:

  • Vandalism,

  • Water damage,

  • Fire,

  • Glass breakage, and

  • Theft.

Protecting your property

Finally, besides revisiting your coverage, you should also take steps to protect the property:

  • Visit the property at least weekly, or hire a property management company to do so.

  • Clear the exterior of the building of scrap wood, paper, cardboard and brush.

  • Remove any toxic substances that could contaminate the area or harm police or firefighters.

  • Maintain sidewalks and parking areas in good condition and clear them of snow and ice.

  • Erect obstacles to keep vehicles and pedestrians out of parking areas.

  • Hire security guards to watch the building at night, and have exterior lighting turned on.

  • Maintain heat or drain the plumbing system to keep pipes from bursting, but keep at least a minimum temperature in areas protected by automatic sprinkler systems.

  • Maintain electricity supply to emergency lighting and exit signs.

  • Shut off utilities, except where necessary to power desired lighting and alarm systems.

  • Maintain fire detection systems and link them to a central station monitoring service.

A vacant building is never a good situation, but with the proper precautions, the owner can maintain its value and keep it secure until new tenants move in.

Workers Who File Claims More Likely to File Subsequent Ones

A new study has found that people who have had workers’ comp claims in the past are more likely to file future claims compared to those who have never suffered an on-the-job injury.

The study – the subject of an article published in the Journal of Occupational and Environmental Medicine – concluded that a past claim is the most predictive factor in determining the likelihood of future workers’ comp claims.

While the findings shed light on a significant driver of workplace injuries, employers are in a difficult position as asking prospective employees about past claims experience is illegal in most jurisdictions.

The main findings of the study, “Reoccurring Injury, Chronic Health Conditions, and Behavior Health: Gender Differences in the Causes of Workers’ Compensation Claims,” are:

  • A higher proportion of both men and women who had filed workers’ comp claims in the past also experienced a subsequent workplace injury.

  • For both genders, a past claim is the most predictive factor in determining the likelihood of filing a future claim.

  • Women who had certain pre-existing behavioral risk factors like depression, poor sleep habits and headaches were more likely to file a subsequent claim if they had already filed one. These same risk factors did not add to the likelihood among men in filing second claims.

  • Future claims are associated with individual workers’ overall health.

The takeaway

Besides addressing workplace hazards proactively, anytime you have a workplace injury, you should investigate to determine how the incident occurred. Once you identify what went wrong or broke down in your processes leading to the incident, you can address the problem through new safeguards and training.

Also, if an employee does file a claim, when they are back on the job you should give them additional safety training and attention to reduce the chances of them suffering future workplace incidents.

And what about prospective employees? First off, most states bar employers from asking prospective hirees about any past workers’ comp claims they have filed with previous employers.

The Federal Americans with Disabilities Act, as well as numerous state laws, seeks to protect job seekers from discrimination in hiring as a result of filing valid claims.

The bottom line is that an employer cannot request workers’ compensation records in order to have a policy of not hiring anyone who has made a claim. It is discriminatory to penalize a person who has exercised a lawful right in a lawful way and filed a valid claim.

Many business owners think the only option for their Workers’ Compensation Insurance is through a state or assigned risk plan.  Many are not aware of the other choices they have when it comes to buying this coverage.

Let’s start with insurance companies that offer stand-a-lone, Workers Comp Policies.  Usually their rates are guaranteed for one year.  Businesses pay a fixed, monthly premium. To bind coverage usually a 25% deposit is required.  This deposit is required to be paid each policy year.  Depending on company, they may offer a pay-as-you go payment plan.  This is the main type of Workmans Comp policy business owners purchase.

Another option, which few business owners know about, is a company that offers a payroll/workers’ compensation plan.  This plan, around for 24+ years, has several features designed to help auto services, contractors, limousine services, moving & storage agents and local truckers and their employees.  Note this is the ONLY program we know that’s been in existence 24+ years (it offers long-term coverage stability which we feel is important), the payroll company owns their workers compensation company.  This allows them to insure riskier classes of business such as the ones mentioned above. This company has a separate division which allows them to offer all types of Contractors Insurance like Commercial General Liability, Commercial Umbrella Liability and Business Auto Policies.

There are other payroll companies offering Workers Compensation Insurance.  They have agreements with insurance companies and payment for coverage is usually deducted weekly or bi-weekly.  Most of their companies are conservative with the types of businesses they’ll insure.  If you fall into a low risk category like a florist or electrician, they’ll have no problem insuring you.  Some of their companies offer competitive rates.  With others, their rates can be high.  Some payroll services add fees on top of what they get paid from their insurance companies.  BUYER BEWARE!

Finally, if you have poor loss experience and a high experience modification, making it difficult to get insurance, there are Professional Employer Organizations (PEO) that may come to your rescue!  They couple payroll service with workers compensation. They are like payroll/wc plans but technically/legally are set up differently.  One technicality is they are considered co-employers.  This means they have say over who you hire.  Some plans offer the option to purchase affordable health insurance. This is another way to “Skin a Cat” if you need Group Health Insurance.  Rates are competitive.  Provider networks extensive.

Options When You Have These Problems

Depending on the work you do, you may be able to get quotes from several insurance companies or just one.  For example, if you’re an accountant’s office, florist, plumber or electrician, most carriers will offer you workers compensation coverage.  However, if you’re a limousine service, trucker or high-risk class contractor, only one or two carriers may offer coverage.

What if you have poor loss experience?  Usually you have to go to a state or assigned risk plan.  But what if you don’t want to go through one?  What if you previously had coverage with your state’s plan, got cancelled and owe them money?  Usually, unless you pay off balance they won’t sell you a new policy. What if because of poor loss experience their rates are astronomical?  What can YOU do?

Prevent Workers’ Comp Claims by Keeping the Flu at Bay

The federal Centers for Disease Control and Prevention has estimated that between 1.8 and 5.7 million people in the U.S. contracted the H1N1 virus between April and July 2009. While many of them may have picked up the virus from contact with family and friends, it is very likely that many became infected at their workplaces. Infected workers may not have realized they had the virus, or they went to work despite feeling sick. Exposure to communicable illnesses is a common occurrence at the workplace. If an employee becomes ill, misses work, and requires medical treatment, does the employer have to provide her with workers’ compensation benefits?

Workers’ compensation laws require employers to pay benefits to workers who suffer injuries or illnesses that arise out of their employment. It may be relatively easy to determine that a particular injury arose from someone’s employment. For example, a carpenter who slips and falls off a ladder while installing walls in a new home is clearly on the job; Workers’ compensation should cover the costs resulting from the injury. Illnesses, especially viral illnesses like influenza, can be more difficult for investigators to trace. A worker who gets sick may have contracted the virus at work, at the gym, on the subway, or any number of places.

According to the International Risk Management Institute, insurance investigators and physicians must answer several questions about an individual’s illness to determine whether it is work-related.

  • Is the relationship of the illness to the exposure at work logical and plausible?
  • Was the dose of the viral agent to which the person was exposed large enough to cause the illness?
  • Are the person’s signs, symptoms, and test results characteristic of what a person with the illness would have?
  • Where exactly did the person come into contact with the viral agent?
  • Could the person possibly have been exposed to the viral agent outside of the workplace?
  • Does all the evidence establish that the person’s exposure to a viral agent at work caused his illness?

People may be exposed to H1N1 and other flu strains in dozens of places, only some of which are work-related. Employers must evaluate the facts of a particular case when deciding whether or not to contest a workers’ compensation claim for work-related illness. If the employee’s duties kept him solely within the office and no other employees showed any flu-like symptoms, the employer may successfully contest the claim. However, if other employees gave signs of having the flu or the worker regularly has physical contact with vendors or customers who might have exposed him, the worker’s claim may be successful.

  • Encourage employees to get vaccinations each year as the flu season approaches.
  • Foster a work environment where employees who feel ill can stay home from work without fear of negative consequences.

Back Injury Prevention in the Workforce

While the effects of job-related back injuries are readily known, the causes and how to prevent such injuries should take center stage for both employers and employees. Many companies offer in-house training and courses to help educate management and workers on how to avoid back injuries. A common program found in many companies is an injury prevention course that promotes safe work habits such as:

Break the Cycle of Workplace Accidents with Effective Accident Investigations

You’ve heard the old adage about people not learning from history being doomed to repeat it? This is certainly applicable to the safety programs of businesses. If accidents are to be avoided, the business must learn how and why they happen in the first place. It’s only through this knowledge that businesses can prevent alike accidents from reoccurring.

An accident investigation should be devised in a manner that will thoroughly and objectively gather information, not assign blame and carelessly point fingers. Accidents are rarely the result of one solitary causative agent. In fact, they generally involve a multitude of direct and indirect factors that result in human failure, mechanical failure, and/or poor work environment. Once a thorough investigation is completed, the business should effectively be able to develop new training and safety protocols to prevent the same incident from happening again. Here are ten tips to assist you in thoroughly conducting an investigation into an accident:

  1. Always make sure any injured individuals receive appropriate first aid treatment and medical care.
  2. Don’t disturb the area where the accident took place.
  3. Secure the accident area.
  4. Ensure the site is safe before beginning an investigation, but begin the investigation as soon as it is safe to do so to make sure that evidence hasn’t been disturbed and the incident is fresh on the minds of witnesses.
  5. The safety program should define employee protocol for dealing with an accident site.
  6. The safety program should also have an investigation guideline and checklist to ensure proper protocol adherence.
  7. Materials needed to conduct an investigation should be readily available – camera, video recorder, personal protective equipment, notepads, pens and markers, accident and incident forms, checklists, measuring tape, evidence containers, and so forth. These should be used to thoroughly document the site of the accident, gather and record information, and preserve evidence.
  8. All witnesses should be documented immediately and interviewed as soon after the accident as possible.
  9. Anyone that used the equipment involved or that was near the accident scene just before or after the accident should also be documented immediately and interviewed as soon as possible.
  10. Objective questions should be asked in a manner that will give a comprehensive snapshot of the accident, events leading up to the accident, and the conditions of the environment surrounding the accident. This should include supervisory instruction, equipment condition, work protocol, weather conditions, and such.

Don’t Let Shabby Incident Investigations Leave You Vulnerable

Employers should always make it a top priority to provide workers with a safe working environment. That said, accidents can still happen, even when employers strictly enforce safety practices and employees strictly adhere to them. Incidents happen due to a breakdown, departure, or failure in the acceptable method of performance. When an accident does unfortunately occur, the incident investigation report will serve in several important objectives. So, it’s vital that a timely and thorough incident investigation takes place.

The Purpose Of Incident Investigation

The main purpose of an incident investigation is for the employer to learn why the breakdown happened and determine procedures that could be put into place to prevent it from reoccurring. The employer should gather and examine the data they collect to figure out where and why the departure from acceptable behavior happened. Employers can learn from errors and increase future productivity from knowing if there was any indication of the breakdown prior to it occurring, or if there was any possible point that the breakdown could have been interrupted and stopped.

Legal liability is another purpose of investigating the incident. During the investigation, the employer will gather information that could be paramount in mounting a possible defense against any resulting lawsuit(s). The investigative process will begin as the scene of the incident is reviewed and examined. This can provide an exact reason, or possible scenarios, as to why the incident happened. Pictures should be taken of the incident scene. The pictures can later be compared to blueprints, diagrams, or drawings of the area to help determine what chain of events led up to the incident occurring.

Now, it’s time to question all witnesses that may have information leading up to, during, or just after the incident. You can use forms created by regulatory agencies or internally created forms to guide the questioning process. Either way, using the completion of the form as a format for the questions asked will help to maintain objective questioning of witnesses, no matter who is asking or being asked the questions. It’s human nature for most people to immediately form assumptions and theories following the incident. Keep in mind that this type of non-factual information is useless and adds nothing to the validity of the investigation.

All the gathered information will be carefully analyzed by the investigator to determine what elements are explainable and what elements still need an explanation. The chronology of the chain of events will be explored. Then, the actions of those involved are looked at along side concurrently occurring actions to see if any of the concurrently occurring actions had any bearing on the incident.

Following the analysis, the investigator will make a written report that contains a description of the incident, the circumstances and elements that led to the incident occurring, why the incident occurred, and any recommendations to prevent it from reoccurring. The report should accompany the physical documentation collected by the investigator.

While an incident investigation is initially about investigating, it makes little sense to know the what, how, and such of the incident if nothing is done to prevent it from reoccurring. So, the last stage of the incident investigation is about implementing the recommended changes suggested in the final report. For optimal success during the implementation stage, the employer should assign a task force to ensure that the recommendations are put into place, supported from the top down, and are subsequently followed by everyone.
