DOL Nixes Trump-Era Rule on Independent Contractors

President Biden’s Labor Department has rescinded a Trump-era rule that would have made it easier for businesses to classify workers as independent contractors instead of employees under the federal Fair Labor Standards Act.

In the last month of the Trump administration, the Labor Department finalized a regulation to clarify for employers which workers are employees and which are independent contractors.

Labor unions and worker representatives had complained loudly about the rule. They said that by making it easier to classify workers as independent contractors, it allowed employers to avoid providing a number of worker protections including the right to a minimum wage, workers’ compensation insurance, meal breaks, employee benefits and more.

While the focus has been on the rule’s effect on gig workers (like Uber and Doordash drivers), it also included other independent contractors that thousands of businesses employ.

The Trump-era rule was slated to take effect in March until the Biden administration put that on hold.

The rule would still have required existing standards (explained below) to be applied when determining whether a worker is an independent contractor or employee, but the following two current standards would have taken precedence:

  • The worker’s ability to earn a “profit or loss.” This factor weighs the extent the individual has an opportunity to earn profits or incur losses based on his or her own initiative, management of investment, or both. For example, if an individual can meaningfully increase their earnings by investing in their own equipment and delegating work to subcontractors, they likely qualify as an independent contractor.
    In this case, if an individual is unable to affect their earnings or is only able to do so by working more hours, they are likely an employee.
  • The nature and degree of control over the work. This factor measures the extent the individual, or the employer, exercises substantial control over key aspects of the work. This includes setting one’s schedule, selecting projects and determining how to do the job.

Companies that use gig economy workers had cheered the Trump administration’s final rule.

The DOL said it had withdrawn the rule because it was inconsistent with the text and purpose of the FLSA and would have had “a confusing and disruptive effect on workers and businesses alike due to its departure from longstanding judicial precedent.”

A group of companies that counts Uber, Lyft and Postmates among its number have filed suit to block the new administration’s attempt to rescind the rule.

What now?

With the rule withdrawn, the “Economic Realities Test” is still the test for determining whether a worker is an employee or an independent contractor under the FLSA, and employers will need to continue following this test. Some states, like California and New York, have stricter tests for determining contractor status.

The test the DOL uses derives its position from judicial precedent. The U.S. Supreme Court has not established a single rule or test for determining whether an individual is an independent contractor or an employee, but the DOL stresses seven factors the Court has considered significant in past rulings. These are:

  1. The extent to which the services rendered are an integral part of the principal’s business.
  2. The permanency of the relationship.
  3. The amount of the alleged contractor’s investment in facilities and equipment.
  4. The nature and degree of control by the principal.
  5. The alleged contractor’s opportunities for profit and loss.
  6. The amount of initiative, judgment or foresight in open market competition with others required for the success of the claimed independent contractor.
  7. The degree of independent business organization and operation.

Five Tips for Employing Teen Workers

As summer nears many businesses are ramping up hiring of teen workers, with many companies this year taking them on as they deal with the labor shortage as the country emerges from the COVID-19 pandemic. Others employ teens year-round.

Taking on a teen worker comes with added responsibility in terms of compliance with state and federal laws, as well as workplace safety. Each year, 70 teenagers die while working in the U.S., while about 100,000 are injured seriously enough to require emergency room treatment.

Keep in mind there’s a lot that employers can do to prevent injuries to their teen workers, and the measures you take to keep them safe will help protect all your employees. The following are some tips you can follow if you employee teenagers:

  1. Workplace safety — Know the law and OSHA workplace safety and health regulations, which are designed to protect all employees, including teens, from injuries. Ensure that all jobs and work areas are free of hazards. The law requires you to provide a safe and healthy workplace. Involve every worker in your Injury and Illness Prevention Program.
  2. Train teens to put safety first — Give clear instructions for each task, show them what safety precautions to take and point out possible hazards. Prepare teens for emergencies, accidents, fires and violent situations. Show them escape routes and explain where to go if they need medical treatment.
  3. Increased supervision — Teenage workers not yet accustomed to working typically require close supervision, and they may also require more instruction and repetition to learn a task than their adult counterparts.
    Instill good working habits in teen employees by encouraging them to ask questions and always request assistance when necessary. Be patient, even when you find yourself answering the same question more than once.
  4. Check your compliance — Make sure teenagers are not assigned work schedules that violate the law, or are given prohibited tasks like operating heavy equipment or using power tools. Also ensure they have their work permits if aged under 18.
    The Department of Labor has strict rules about 14- and 15-year-olds, particularly in terms of hours they are permitted to work. Although there are no specific federal laws restricting the working hours of minors age 16 and 17, you must comply with all state laws that do, as well as any state laws that further restrict the working hours of minors age 14 and 15.
  5. Know the law — Make sure also that your supervisors who give teens their job assignments know the law. Encourage supervisors to set a good example, as they are in the best position to influence teen attitudes and work habits.

Federal Paid Sick Leave Legislation Introduced

Two U.S. senators have introduced legislation that would require employers around the country with 15 or more workers to provide up to seven days of paid sick leave annually to their staff.

The effort is part of a rumble that started at the state level, where a handful of states have enacted paid sick leave laws. The issue has gained traction during the pandemic, which has shined a spotlight on leave policies that left many employees forced to choose between their health and going to work because they could not afford to take time off.

The bill’s author — Congresswoman Rosa DeLauro (D-Conn.) — noted in the legislation that 29% of the private sector workforce and 9% of the public sector workforce lack paid sick time.

“Working people without paid sick days are more likely to go to work sick and delay or forgo needed health care,” the bill states “A 2016 study in the journal Health Affairs found that working adults without paid sick days are 3 times more likely to forgo medical care for themselves, and 1.6 times more likely to forgo medical care for their family, compared to

working adults with paid sick days.”

The key elements

Here are the nuts and bolts of the bill:

  • It applies to employers with 15 or more workers.
  • It requires employers to let full-time employees earn up to 56 hours of paid sick time, including paid time for family care. Employers can choose to provide more than that, but not less.
  • It requires employers to provide one hour of earned paid sick time for every 30 hours worked.
  • It requires employers with fewer than 15 workers that opt not to offer paid sick leave to provide up to 56 hours of unpaid sick leave during the course of a year to each full-time worker. This provision is treated in all respects as the provision for paid sick leave, but with no pay.
  • Employers must carry over any unused paid sick time earned from one year to the next.
  • Employees will begin to earn paid sick time when they start a new job and will be eligible to take paid sick time starting on the 60thcalendar day after their first day on the clock. After that 60th calendar day, the employee may use the paid sick time as the time is earned.
  • Employers may “loan” paid sick time to an employee to use before their 60thday of employment.
  • The law would not require employers that already provide up at least 56 hours of paid sick leave a year to provide additional paid sick leave.

Under the legislation, a worker could take paid sick leave for:

  • An absence resulting from a physical or mental illness, injury or medical condition.
  • An absence resulting from obtaining professional medical diagnosis or care, or preventative medical care.
  • An absence for the purpose of caring for a child, parent, spouse, domestic partner or any other individual who they have a relationship with, or to attend a school meeting for their child.
  • An absence resulting from domestic violence, sexual assault or stalking.

State of play in Congress

The bill was introduced in mid-April and the House leadership has signaled support for the measure. There are rumblings that mirror legislation will be introduced in the U.S. Senate in May.

The Effects on Your X-Mod When Purchasing Another Company

Many companies are often taken off guard when their workers’ comp X-Mod shoots up after a merger or acquisition.

The experience modifier spike is usually the result of the other employer having a less than stellar workplace safety record and high workers’ comp claims costs.

But there are pre-emptive steps you can take to understand the impact of a merger on your X-Mod and, the more you know, the better chance you’ll have at coping with the changed circumstances.

The reason is that workers’ compensation rating bureaus have strict rules regarding mergers and acquisitions to ensure that companies don’t engage in shell games to hide their true workers’ comp claims experience.

The majority of states have the same rules for ownership changes and their effect on X-Mods.

First, let’s look at what a rating bureau will consider to be a change in ownership. Typically, that would mean:

  • All or a portion of the ownership in an entity is sold, transferred or conveyed from one person to another.
  • An entity is dissolved or non-operative, and a new entity is formed.
  • Two or more corporations undergo a statutory merger or consolidation.
  • All or most of the tangible or intangible assets of an entity are sold, transferred or conveyed to another entity.
  • A trusteeship or receivership is set up, either voluntarily or at the direction of the courts, to operate a business.

What will happen

Rating bureaus will have something known as the “Notification of Change in Ownership Endorsement,” which requires that the purchasing party or merged entity report the ownership change within 90 days of the transaction.

Once that is done, the bureau will combine the experience of the two companies on a weighted basis to calculate a new X-Mod. It will do that by transferring the experience of the selling entity to that of the purchasing entity.

It’s the rating bureau’s job to review information you submit and make a decision as to how the change in ownership will affect the X-Mod for both the selling and purchasing entity.

They will decide, according to the rules for the purchasing entity, whether the modification factor will be adjusted to reflect the experience of the newly acquired business.

What you need to do

An ownership change can have a number of ramifications for an employer in terms of workers’ comp, the most significant of which would be a change to its X-Mod.

It may also have an effect on your anniversary rating date and your rating effective date.

If you run the purchasing entity, the best course of action is to review the workers’ compensation history of the company being purchased so you have a full understanding of its workers’ comp experience.

If they have a high incidence of workplace injuries, you can take pre-emptive safety measures when integrating the other company’s workforce.

You should also come to us if you know that you will be merging or acquiring another entity. We can run a test calculation to approximate what your new X-Mod will be.

We will pull your company’s data from the unit statistical report that your insurer submitted to the rating bureau, as well as that of the company you are purchasing. We can at that point determine the accuracy of the report in terms of your claims costs, payroll and classification codes.

Once we have the other employer’s information, we can crunch the numbers to come up with an estimate for your new X-Mod.

One more thing: Failure to report changes in ownership to your insurer may be considered X-Mod evasion and has serious implications. If the rating bureau determines evasion, it can go back as far as it chooses to examine your workers’ comp history.
