EEOC Issues Construction Industry Harassment Prevention Guidance

The Equal Employment Opportunity Commission has issued new guidance for preventing harassment on construction industry worksites.

The guidance, while not binding, can be used as a template for construction firms to implement anti-harassment policies. According to the EEOC, the industry has an especially high incidence of harassment complaints, and “some of the most egregious incidents of harassment investigated by the EEOC have arisen in the construction industry.”

The nature of the construction industry includes risk factors that may increase the likelihood of harassment, including workforces that are primarily male, those where there is pressure to conform to traditional stereotypes, and decentralized workplaces, according to the EEOC.

These factors may be exacerbated by the presence of multiple employers on a worksite, and the cyclical, project-based nature of construction.

The guidance, “Promising Practices for Preventing Harassment in the Construction Industry,”  outlines the main principles for implementing an effective strategy to prevent workplace harassment, as follows:

Buy-in from leadership

Worksite leaders, from the project owner to crew leads to union stewards, should clearly, frequently and unequivocally message and demonstrate that harassment is prohibited.

The EEOC recommends that project owners and general contractors prioritize and emphasize  worksite-wide collaboration to prevent and correct harassment. The general contractor is typically well positioned to coordinate harassment prevention across a worksite and serve as a backstop for resolving difficult issues

General contractors should assist subcontractors and staffing agencies with their legal obligations under federal anti-discrimination laws by referring them to the EEOC’s Small Business Resource Center.

It also recommends that project owners or sponsors consider requiring that contract bids include a plan to prevent and address workplace harassment.

Strong and comprehensive harassment policies

Policies should include:

  • A clear description of prohibited conduct, with examples tailored to the work environment, such as taunting tradeswomen when they are performing a difficult or dangerous task, or vandalizing the toolboxes or personal protective equipment of Black workers.
  • An unequivocal statement that harassment is prohibited.
  • A description of complaint and reporting processes, and where to find more information about them.
  • A commitment that the employer will provide a prompt, impartial and thorough investigation, and that it will keep confidential the identity of individuals who make reports.
  • A statement that workers are encouraged to report harassment, bullying or other inappropriate conduct even if they are not sure if the conduct violates the policy.
  • A discipline policy that is prompt, consistent and proportionate to the severity of the harassment or related misconduct, such as retaliation.
  • An unequivocal statement that retaliation for reporting harassment is prohibited.
  • Account for language barriers in the workforce, such as for non-native English speakers or workers with poor literacy.

Policies should also include steps for when a subcontractor lacks the experience or resources to resolve an issue, takes inadequate steps to address or prevent harassment or fails to take reasonable corrective action in response to harassment.

In such instances, a general contractor should consider facilitating and assisting subcontractors in finding solutions, especially when harassment is occurring between workers from different employers.

Regular and effective training

All workers should be regularly trained on the harassment policy and complaint system.

Training should be:

  • Clear, easy to understand and offered in languages commonly used by onsite workers;
  • Tailored to the specific workforce and work environment; and
  • Interactive, if feasible. Alternative options include providing training through an interactive module accessible via mobile phone or watching a series of short video clips, followed by a guided discussion about the clips.

How Your Business Can Survive a Hurricane

A hurricane can grind a business’s operations to a halt, possibly for a long period of time. But if weather forecasts warn that a hurricane is approaching, there are steps you can take to prepare and recover.

You’ll have to plan for both windstorm damage as well as possible flooding as claims for the latter continue to grow as storm surges grow increasingly higher due to climate change and rising sea levels.

Fortunately, you can take the following steps to minimize losses, soften the financial impact, and enable operations to resume quickly.

What Business Insurance Policies Cover Rioting, Looting

Protests and mass demonstrations that can sometimes descend into rioting and civil unrest are becoming more common not just in the U.S., but all over the world. Businesses can sometimes unwittingly become collateral damage from vandalism and looting.

It doesn’t have to be a retail establishment; office buildings and other commercial properties can also face looting and damage during civil unrest. For business owners whose properties are damaged or destroyed, the ordeal can be both unsettling and stressful as they wrestle with the specifics of filing insurance claims.

Fortunately, you don’t need special insurance policies to cover these events. Your basic commercial property policy and commercial auto (if you have business vehicles that are damaged) will usually suffice.

Here’s a look at what your policies may cover and how to prepare for filing a claim if your business is damaged during rioting or civil unrest.

Property damage

Standard commercial property policies cover damage to a business property caused by fire, explosion, riot or civil commotion, vandalism or malicious mischief. This would include coverage to the structure, as well as any inventory, fixtures and other contents. Business owner’s policies also include this risk.

Damage payouts would be subject to sublimits (specific or blanket) for inventory, fixtures and other items, as well as the policy deductible.

Commercial vehicle damage

For business-owned vehicles to be covered for damage for these types of events, you’ll want to ensure that you have purchased comprehensive coverage, which is an optional, but highly recommended part of your policy.

Comprehensive coverage may cover a vehicle if it is:

  • Stolen,
  • Damaged, or
  • Destroyed.

One of the most common damages to vehicles during riots is broken windshields, which you can usually get covered with an optional glass coverage rider.

Business interruption coverage

Companies that are forced to close as a result of rioting and looting damage may have coverage for business interruption under a business property policy.

Business interruption insurance may cover lost income if a company is unable to operate after its premises were damaged during a riot or social unrest. Coverage may also apply if a business suffers a loss of income because of curfews or if authorities bar access to a property.

Coverage is typically triggered if there is direct physical damage to the premises.

Filing a claim

When filing a claim, read your policy or give us a call to determine how to best present it. It’s important to understand the policy’s limits and deductibles before spending time documenting losses that may not be covered.

If you are going to file a claim, document all damage. Keep receipts for all your inventory and fixtures.

In the event of a claim:

  • Take photos of all damage.

  • Keep receipts for any remediation work.

If you’re going to file a business interruption insurance claim, you will need:

  • Receipts for building materials, a portable generator and other supplies needed for immediate repairs or remediation.
  • Paid invoices from contractors, security personnel, media outlets and other service providers.
  • Receipts for rental payments, if you move your business to a temporary location.

Note: Many policies require a 72-hour waiting period before a policyholder can begin making a business interruption claim. That’s because the first three days of business shutdown, access constraints or limited hours of operation because of a civil authority action, are often excluded from coverage.

There may also be a limit to the claim period. A standard limit is up to three weeks of losses.
