Don’t Let Shabby Incident Investigations Leave You Vulnerable

Employers should always make it a top priority to provide workers with a safe working environment. That said, accidents can still happen, even when employers strictly enforce safety practices and employees strictly adhere to them. Incidents happen due to a breakdown, departure, or failure in the acceptable method of performance. When an accident does unfortunately occur, the incident investigation report will serve in several important objectives. So, it’s vital that a timely and thorough incident investigation takes place.

The Purpose Of Incident Investigation

The main purpose of an incident investigation is for the employer to learn why the breakdown happened and determine procedures that could be put into place to prevent it from reoccurring. The employer should gather and examine the data they collect to figure out where and why the departure from acceptable behavior happened. Employers can learn from errors and increase future productivity from knowing if there was any indication of the breakdown prior to it occurring, or if there was any possible point that the breakdown could have been interrupted and stopped.

Legal liability is another purpose of investigating the incident. During the investigation, the employer will gather information that could be paramount in mounting a possible defense against any resulting lawsuit(s). The defense team in such lawsuits will build their strategy based on the what, when, who, where, why, and how of the incident, data that’s often revealed during the incident investigation.

How Should The Investigative Process Take Place?

The investigative process will begin as the scene of the incident is reviewed and examined. This can provide an exact reason, or possible scenarios, as to why the incident happened. Pictures should be taken of the incident scene. The pictures can later be compared to blueprints, diagrams, or drawings of the area to help determine what chain of events led up to the incident occurring.

Now, it’s time to question all witnesses that may have information leading up to, during, or just after the incident. You can use forms created by regulatory agencies or internally created forms to guide the questioning process. Either way, using the completion of the form as a format for the questions asked will help to maintain objective questioning of witnesses, no matter who is asking or being asked the questions. It’s human nature for most people to immediately form assumptions and theories following the incident. Keep in mind that this type of non-factual information is useless and adds nothing to the validity of the investigation.

All the gathered information will be carefully analyzed by the investigator to determine what elements are explainable and what elements still need an explanation. The chronology of the chain of events will be explored. Then, the actions of those involved are looked at along side concurrently occurring actions to see if any of the concurrently occurring actions had any bearing on the incident.

Following the analysis, the investigator will make a written report that contains a description of the incident, the circumstances and elements that led to the incident occurring, why the incident occurred, and any recommendations to prevent it from reoccurring. The report should accompany the physical documentation collected by the investigator.

While an incident investigation is initially about investigating, it makes little sense to know the what, how, and such of the incident if nothing is done to prevent it from reoccurring. So, the last stage of the incident investigation is about implementing the recommended changes suggested in the final report. For optimal success during the implementation stage, the employer should assign a task force to ensure that the recommendations are put into place, supported from the top down, and are subsequently followed by everyone.

Get Your Ducks in a Row before, during, and after a Premium Audit

It might be hard to fathom any type of audit being beneficial, but premium audits are actually just as important to you as they are to your insurance carrier. When you were first issued your policy, the carrier looked at the estimated sales figures or payroll data that you provided to them. They calculated your premiums based on this information. Now that you have real numbers under your belt and an actual experience, the information can be reassessed to determine the correct premium amount.

Depending on how your business operates and the size of your policy, there are several different methods your insurance carrier can use to conduct your premium audit, including:

1. Mail – your carrier will mail you an audit form and the instructions to complete the form. Once completed, you will return the form by mail to your carrier.

2. Phone – your carrier will hire an independent audit company to conduct your audit over the phone.

3. Physical – your carrier will usually conduct the audit at your business, but it could be conducted at an alternative location, such as your certified public accountant (CPA’s) office.

Regardless of the method, the audit will typically include your disbursements and payroll journals, ledgers, tax and Social Security reports, state unemployment forms, and other accounting records being inspected. As you can see, an enormous amount of data will be inspected. You can use the following tips to help you prepare for your audit, help it run smoothly, and end positively.

Before The Audit Arrives

* You should try to get an idea of what the auditor will be reviewing by looking at the auditor’s work sheets and past audit billing statements.

* Determine which of your employees would be best suited to work with the auditor. Look for someone that’s both knowledgeable about the accounting records that will be used in the audit and about what work is done by various employees and departments.

* Assemble all the accounting records that will be used during the audit.

* Ensure that you have certificates of insurance on hand for all subcontractors you’ve used. Don’t forget to make sure that your documentation shows all the contractors have their own general liability insurance and workers’ compensation.

* Check that your payroll documents include a breakdown of wages according to class code, department, and employee.

The Day Of The Audit

* To make sure you have all the applicable records easily available to the auditor, you might request the audit be conducted at your business.

* Don’t be afraid to ask the auditor to explain any points that aren’t perfectly clear to you.

* Request a hard copy of what the auditor finds.

After The Audit

* Carefully assess the audit billing statement, comparing it to your original policy.

* Don’t agree to pay any additional premium dollars until after you’ve made a list of all changes and discussed any problematic areas with the auditor.

Is Your Business Ready for an Earthquake?

Being prepared for an earthquake is a good investment if you are in a quake-prone area. At least one-fourth of all businesses that close because of a disaster never reopen, mostly because they are unprepared.

“Is Your Business Ready” questionnaires are a great place to start to help you determine how you might respond in case of a major earthquake (you’ll find the quiz below).

Once you know the results of the questionnaire, you can start preparing a business continuity plan to ensure core functions and key personnel are identified and to ensure normal operations can resume as quickly as possible after an earthquake. Consider the following:

Fix hazards in the workplace. Do a walkthrough with key personnel to identify issues that may become hazards in case of a temblor. That may include fixing loose shelving, removing heavy items from top shelves, securing cabinets with breakables in them, and securing wall fixtures and inventory to avoid damage to the products or injury to staff.

Set evacuation procedures. Develop and test an emergency evacuation procedure and create a shelter in a place at your business where you can house employees or customers if necessary. Establish a designated emergency area outside of the workplace for your staff to meet after an event. Ideally, the location should be open-air and free of other buildings or power lines.

Make sure that your employees are aware of the site of the designated emergency area. Conduct a roll call of employees, depending on the size of your company.

Create a communication plan. Develop a communication plan to implement following a quake. Make sure you have a list of key contacts — personnel, vendors and suppliers, etc. — and develop a media communication plan so you can reach your customers through news channels.

Take steps to protect vital records. There are many vendors who provide off-site storage of data. Ask your peers for recommendations or check with your insurance agent, who may have access to business recovery vendors.

Earthquake insurance

Earthquake insurance is not covered under a standard business insurance policy. Similar to flood insurance, earthquake coverage usually must be purchased separately, either as a stand-alone policy or what’s known as a “differences in conditions” policy.

Stand-alone earthquake insurance typically covers the cost of repairs to property damaged in a quake as well as damaged and destroyed furnishings, equipment and inventory. There may also be coverage for fire following a quake.

Policies may also cover claims for business interruption costs. Vehicles are covered for earthquake damage under the comprehensive part of a commercial insurance policy.

Small business owners should calculate the full sum it would take to repair or rebuild the business in the event of an earthquake. This covers a wide range of costs, from engineering requirements for rebuilding office space to inventory storage while repairs are being done to the building(s).

Coverage for other kinds of damage that may result from earthquakes, such as fire and water damage due to burst gas and water pipes, would not be covered by standard business insurance policies.

However, one of the most common types of damage from an earthquake is water damage resulting from broke sprinklers that turn on when the building shakes. An earthquake sprinkler leakage or sprinkler leakage endorsement may provide coverage for the building and/or contents inside the building should the sprinkler system leak due to a quake or accident.

  9. Regularly backed up your data and are storing backup copies off-site, or on the cloud?
  10. Taken steps to safeguard against potential damage to your equipment, buildings or facilities?
  11. Maintained procedures to communicate after a disaster with employees, suppliers and vendors?

Self-Assessment Results

If you got 9-11 correct: Your organization is better prepared than most (possibly even your competitors) and there are simple resources to address any gaps.

If you got 5-8 correct: Your organization has taken some preparedness steps. You are at less risk, yet there is room to improve.

Stressed, Burned Out Workers May Compromise Safety

Americans are working longer hours and facing more demands for productivity, leading to stress and burnout, which in turn can affect workplace safety, according to risk management experts. Understaffing plays a part in this, they found.

When workers are stressed or required to work quickly, they are more prone to making mistakes that can injure themselves or co-workers.

On top of that, there’s been an increase in mental health issues, while outside factors like household finances can also add to an employee’s stress, making them less mindful at work.

Fed-OSHA has also noted a correlation between worker stress and industrial injuries. In May 2023, it launched a web portal for employers to understand and recognize the workplace safety implications of stressed workers and what they can do to help.

Poll findings

A recent poll of 2,515 workers by the American Psychological Association (APA) found that 77% of respondents said they had experienced work-related stress in the last month and 57% said they were experiencing negative effects of work-related stress driven by burnout, including:

  • 31% reported feeling emotionally exhausted,
  • 26% said they don’t feel motivated to do their best,
  • 25% had a desire to keep to themselves,
  • 23% wanted to quit,
  • 20% reported lower productivity,
  • 19% said they felt irritability or anger with co-workers or customers, and
  • 18% said they felt ineffective.

Stress is especially prevalent in production environments, where the safety stakes are the highest. This includes construction, manufacturing, warehousing, health care and transportation. In these industries, the risks can range from amputations and crushing injuries to falls and muscle sprains. Inattention while working in these sectors can be deadly.

While OSHA cannot cite an employer for workplace stress, it can cite them for injuries that may have been influenced by stress.

Workplace stressors

According to the APA, workplace stress is caused by a multitude of factors, including:

  • Toxic workplaces.
  • Verbally abusive superiors, co-workers or customers.
  • Difficult-to-meet deadlines or quotas.
  • Too much or too little work.
  • Poor work relationships.
  • Poor communication from management, or management that does not provide leadership.
  • Insufficient compensation.
  • Uncomfortable workplace environment.


Some of the main risks of stressed or burned-out workers are:

  • Workers in understaffed environments or who are under pressure to meet difficult quotas are more prone to make mistakes or cut corners, leading to injuries or costly mistakes.
  • Lapses in concentration that can lead to injuries and mistakes.
  • Stress can lead to substance use disorders.
  • Reduced engagement with colleagues and supervisors.
  • Increased sick days and absences.
  • Reduced productivity.

What employers can do

Recognizing that workers may be under stress, employers can take steps to help their workforce. OSHA and the APA recommend the following:

  • Be aware and acknowledge that people can carry an emotional load that is unique to their own circumstances. They may be experiencing heightened levels of loneliness, isolation, uncertainty, grief and stress; and some may face additional demands, such as parents caring for children or elderly household members.
  • Identify factors making it harder for workers to get their jobs done and determine if adjustments can be made.
  • Show empathy. Employers can reassure employees they are open and receptive to discussions about their work stress by creating a safe and trustworthy space.
  • Offer health insurance with coverage for mental health and substance use disorders.
  • Encourage workers to take their breaks.
  • Offer an employee assistance program.
  • Offer paid time off and sick leave. (The APA suggests 50% of employees find that a lack of paid time off or sick leave has a negative impact on stress levels at work.)
  • Offer paid mental health days off.
  • Train supervisors and managers to avoid being verbally abusive and to treat employees with respect.

Annual Insurance Reviews are Crucial to Growing Businesses

One of the biggest mistakes owners of growing businesses make is not keeping up their insurance coverage to account for the expanding assets and potential liabilities.
