Spotting the red flags that indicate possible workers’ compensation fraud by employees is the best way to prevent fraud from occurring. Knowing how to spot the red flags is a proactive way to nip a potentially costly but false workers’ compensation claim before it begins.

Most instances of workers’ compensation fraud occur when the claimant:

  • Deliberately falsifies information about how an injury occurred, such as claiming the injury was work-related when it was not,
  • Deliberately amplifies the seriousness of an injury to falsely prolong the claim, or
  • Deliberately continues to collect entitlements while working on the sly for their own purposes or with another employer.

Common Signs of Workers’ Compensation Fraud

  • Lack of witnesses – The majority of people claiming false work-related injuries usually do not have witnesses to support their claim. Vigilance is especially necessary when the employee normally works with other co-workers who should have witnessed the injury but did not.
  • Contradictory accounts of how the injury occurred – This can be particularly blatant when any of the doctor’s, employer’s, or witnesses’ reports contradict the employee’s report of the incident. Another red flag should be raised when the employee is deliberately vague about how the injury occurred.
  • Dissatisfied employees – Unhappy employees can be motivated to make a false workers’ compensation claim, especially if a recent incident such as a reprimand, changed responsibilities, or a possible demotion has occurred.
  • Time occurrence of the injury – Many false workers’ compensation claims are submitted before a potential strike, project conclusion, strike, or possible layoff. Many false claims also happen to be submitted on either a Friday or a Monday.
  • Inconsistent injury – The nature and extent of the injury is not consistent with their duties or type of job performed.
  • Inconsistent reporting procedures – Occurs when there is an inexplicable gap between when the injury occurred and when the employee reported the injury. Be alert if crucial injury data is absent, such as no definite time reported when the injury happened or if other vital dates are absent.
  • Lack of contact – The employee cannot be easily contacted by the claims rep or employer. Continuous lack of contact might be indicative the employee is working elsewhere while receiving ongoing entitlements. Another red flag should be raised when the employee immediately moves to another state or foreign destination after going on workers’ compensation.
  • Lack of cooperation – The employee deliberately delays or avoids medical treatment or medical diagnostics needed to clarify the medical condition of the employee’s alleged injury.
  • Physical signs – The employee exhibits physical signs of working such as dirt or grease on their hands or fingernails, work clothes that exhibit traces of work, or scrapes or bruises.
  • Newer employee – From a statistics vantage, new employees are more likely to commit workers’ compensation fraud than senior employees. The most proactive means to counter this is to carefully screen all new employees in the hiring process beforehand.

Although red flags can help minimize potential workers’ compensation losses from fraud, your best strategies to counter this problem should include:

1.   Implement a Zero Tolerance policy for workers’ compensation fraud and be sure your employees know about it.

2.   Take a hands on approach with all workers’ compensation claims and become especially vigilant when red flags appear.

3.   Keep in regular communication with your injured employee.

4.   Have a consistent new employee screening process. Offer new employees a thorough orientation and communicate a comprehensive explanation of the workers’ compensation process along with the employee’s rights and responsibilities.

Legal Traps to Avoid When Dealing with FMLA Requests

If you are confused about navigating the federal Family and Medical Leave Act, here’s a handy list of mistakes to avoid.

Firing – It would be a bad idea to fire an employee if they’re unable to return to work following the end of FMLA leave that is due to their serious health condition. Better to find out if the employee is entitled to any additional time off under employment laws or through company policies.

The Americans with Disabilities Act (ADA) may consider granting of additional leave “reasonable accommodation,” in legal terms.

That definition comes from determining whether the employee’s condition is a disability. Under the ADA, most serious health conditions as defined by the FMLA are considered disabilities. If you’re in doubt, ask your legal counsel for advice.

Then you have to figure out whether the requested time off is legally considered “reasonable.” Under the ADA, you as an employer don’t have to grant leave as an accommodation if it poses “hardship” or “undue hardship.”

Miscalculation – You are able to calculate FMLA leave by either calendar year, any fixed 12-month period, or the 12 months measured forward from when an employee’s FMLA leave begins. It can also be calculated backward from a 12-month period from the date an employee uses the leave.

Deadlines – Meeting FMLA deadlines for processing requests for leave under its guidelines is critical. Within five business days of learning an employee needs FMLA leave, you must provide them with the “Notice of Eligibility Rights and Responsibilities Form,” or something similar that your company has prepared.

Next, if you require the employee to file a certification form, you must allow them 15 calendar days to do so. Then, within five business days of receiving the certification form, you must provide the employee with an FMLA designation form that tells them whether the request has been approved.

But if the certification form is incomplete or insufficient, you then must allow the worker seven calendar days to make necessary corrections in the form. You must give a written notice to employees of all deadlines, and the consequences of failing to meet them. 

Bonuses – Some confusion has arisen over how to determine an employee’s bonus eligibility when they haven’t been able to meet bonus objectives due to FMLA leave. You can disqualify an employee for failing to meet bonus objectives even if they are on FMLA, as long as employees on similar leave are treated the same.

So, an employee who used vacation leave during an FMLA leave should be treated the same as one who used vacation while not on FMLA leave, be it paid or unpaid.

Reassignment – If you want to reassign an employee on FMLA leave for better efficiency, you can only do so for employees who need intermittent or reduced schedule leave.

Reassignments can be done for the employee, family or covered service member if such leaves are a planned medical treatment, a period of recovery from a serious health condition, or due to the birth of a child or placement of a child into adoption or foster care. Beyond that, the reassignment is to be only as long as is required by the leave period.

You are also prohibited from transferring employees to a position to discourage them from taking FMLA leave. That means you can’t demote them from accounting to janitor, even if their pay and benefits remain the same at the reassigned position.

You must make sure, however, that benefits and pay stay the same in the reassigned position. Otherwise, you may be seen as interfering with the individual’s FMLA rights.

Meanwhile, you may not require a transfer to another job when the employee’s need for an intermittent or reduced schedule is unforeseeable.

The takeaway

As you can see, the FMLA is a veritable minefield for employers and, if an employee requests leave under the law, you must make sure you don’t do anything to infringe on their rights, lest you open your organization to being sued.

Wrong class code – Misapplication of job classifications occurs in many workers’ comp audits. With hundreds of job classes to choose from, mistakes can happen.

X-Mod is changed – After your insurer finishes the audit, it will use the information to calculate your premium. When that happens, it has to include your X-Mod to get the right rate. But sometimes the insurer may use an incorrect X-Mod.

Subcontractors are counted – Sometimes insurers will include subcontractors as employees, which results in a new audit bill to account for the additional “employees.” But if they are genuine subcontractors, they should not be counted. Often, uninsured contractors that have insurance will be included as employees. Often it takes hours on the phone and months of waiting before these charges are removed.  The problem is if you are billed tens, hundreds of thousands for subs that have insurance but your company says they don’t you have to pay whats billed or be cancelled.  We have a better way.

Disappearing credits – Most policies will have some sort of premium credits or other modifiers. Sometimes during audits, the insurer will remove them when recalculating the premium they think you owe. Watch out for missing credits and other modifiers if you get an audit bill, like:

  • Premium discount
  • Schedule credits
  • Deductible credits
  • State-specific credits

Audit worksheets missing – If the auditor fails to provide you with audit worksheets, which are used to compile your payroll and other audit information, you should ask to check their work. They will provide you with the information you need to carry out such a check.

Your rates changed – The rates you are charged at the beginning of your policy period must remain the same for the entire policy period. If your base rates have changed, the insurer may have made a mistake.

Separation of payroll – Depending on your industry, you may or may not be able to split your employees’ payroll between job classifications (like cabinet installers and sheetrock hangers). This is a pinch point when errors can occur. If the auditor says you are not allowed to split job classifications even though you have in the past, your audit may be in error.  We have a better way!

Unexpected large premium due – If you get a significant bill for your insurance company after your audit, the auditor may have made mistakes, particularly if you know that your employment has remained relatively stable and you’ve had no significant claims, if any. If it seems out of whack, it probably is.  We have a better way! 

Payroll data doesn’t match – If there is a discrepancy between your payroll data and what you see on the audit, a mistake may have been made. Try to match the payroll on the audit with that generated from your accountant. If the insurer made a mistake, you could end up paying for phantom payroll numbers.  And there are insurers that when they do not believe your numbers create phantom payroll.

No physical audit – There are three types of audits:

  • Mail audit
  • Phone audit, and
  • Physical audit

The mail and phone audits are prone to errors since neither you nor your staff likely have any experience in premium auditing. If you have a big bill after a mail or phone audit, mistakes could have been made.

Employees and independent contractors are different, so it is important for employers to be clear about the difference between the two. This will help them determine what to do when hiring people to help, and it will also affect how they withhold taxes to avoid legal trouble. 

Independent Contractors
Independent contractors have their own employees and usually have their own business name. They typically have a separate checking account for business, and they advertise their own business services. When work is completed, they normally send an invoice or have an agreement for payment. Independent contractors have their own hours, tools and clients. They keep their own business records as well. 

Employees
Employees are hired by a company to work for only that employer unless otherwise agreed. For example, some full-time employees may have a part-time weekend job elsewhere that does not interfere with their commitment to their full-time employer. Employees’ duties and assignments are controlled by the employer or supervisors, and they are provided with training from the employer for the tasks they need to complete.  

Small businesses often depend on independent contractors as workers. For small business owners, there are several benefits to using this approach. They do not have to spend as much for labor costs, their liabilities are reduced considerably and this gives business owners more flexibility for firing or hiring. 

Classification Considerations
Classifying an individual incorrectly as an independent contractor may have several legal consequences that are costly. If an independent contractor meets the definition of an employee, the business owner may have to reimburse that person for wages and overtime that would normally have been paid to them by the Fair Labor Standards Act. The business owner may also have to provide health insurance, retirement or other benefits normally offered to regular employees. Paying back taxes and other penalties would also be necessary, and workers’ compensation would have to be paid to any injured individuals who met the criteria for being employees instead of independent contractors. 

Tax Considerations
The Internal Revenue Service provides information on their site for companies hiring independent contractors and employees. This information is to teach them about tax implications of various scenarios. Site visitors can fill out forms to request that the IRS reviews their workers’ statuses and to provide additional resources. There are no one-size-fits-all tests to determine if a worker is an employee or independent contractor. However, the following considerations are useful in helping classify them: 

– The permanency of the work relationship. 
– The extent to which services provided are an integral part of the employer’s business. 
– The amount of initiative in market competition determining the worker’s success. 
– The worker’s investment in equipment and facilities. 
– The worker’s opportunities for loss and profit. 
– The degree of independent business operation and organization. 
– The degree of control by the business owner. 

Whether a person is considered an employee or an independent contractor will depend on the business owner’s amount of control over the workload and the individual. Workers Compensation Fraud Lands Employers in Hot Water

Workers’ Compensation is a compromise between employers and employees. Employers cover injured employees’ medical costs and lost wages. They do this even if they were not at fault. Employees lose the right to sue their employers over injuries.

State laws require most employers to buy Workers’ Compensation insurance. Employers may see this as money unnecessarily spent. They must pay it even if no injuries occur in their workplaces. Consequently, a minority of them try to cheat the system. Things do not end well for these employers.

Some try to get away with not buying insurance.

  • A Florida married couple owned and operated four supermarkets. One of them went without insurance for 10 years. They were arrested for this and other fraudulent transactions. Authorities estimated the amount of their fraud at $35 million.
  • The owner of a Florida employee leasing company charged his clients millions of dollars for insurance premiums. However, his  policy did not exist. The fraud left 33,000 workers unprotected. His jail sentence was 14 years.
  • Two employees of a Vermont home improvement contractor who skipped insurance got hurt. He was forced to cover $80,000 in medical bills and serve 30 days in prison.

More commonly, employers buy insurance but give their insurers false information. A moving services company in California took this to an extreme.

  • They under-reported payroll to the State Compensation Insurance Fund.
  • They pressured employees to lie about how they were injured. This made the company’s loss record would look good.
  • They failed to pay premiums due, resulting in policy cancellations.

The owner pled guilty to multiple felony counts, received a 16-month jail sentence and was ordered to pay $2.385 million in restitution. His wife also pled guilty, received three years’ probation and had to pay a fine plus $470,000 in restitution.

A common tactic is to misclassify employees.

  • Connecticut construction company told its insurer that it had one employee who did carpentry work. When the insurer audited the company’s books, it found that it had several employees who performed roofing work. The premium jumped from $750 to $51,000. The policy subsequently cancelled for non-payment of premium. Two months after cancellation, an employee suffered serious injuries while doing roofing work. The insurer refused to pay for the claim. The employer sued, but two courts ruled against him.
  • New York tree surgeon was charged with a felony after falsely reporting that an injured worker was an independent contractor and not an employee.

Some employers also try to pass off false evidence of coverage. The owner of an Ohio excavating contractor created false certificates of insurance and submitted them with bids to help him get jobs. In addition, he misclassified employees as independent contractors. He got six months in prison, three years of monitoring, and had to pay restitution.

Employers who try to cheat the Workers’ Compensation system rob their employees of the benefits to which they are entitled. They also gain an unfair advantage over their law-abiding competitors. Employers who decide to play this game should understand that they will eventually lose.

As each year arrives, millions of Americans plan or hope to increase their income and save more money. The National Crime Prevention Council wants to help Americans work toward those goals and protect the financial security of their future. To accomplish this, they offer a variety of tools for protection against investment fraud and identity theft. The tools are available at NCPC.org, and site visitors will also find a variety of helpful publications with tips for protecting themselves against identity theft, mortgage fraud and investment fraud.

According to the NCPC, about 17.6 million Americans were victims of identity theft in 2014. As the year ends and the tax season approaches, there are more occurrences of identity theft. Experts warn Americans to take extra steps to protect themselves during that time especially. However, it is important to make identity theft prevention a regular habit. Identity thieves have several ways to steal information. They may rummage through garbage cans, hack into Internet-based financial accounts or use electronic devices to steal credit card numbers. When they have an individual’s location information, they may even file a change of address form to receive that person’s mail and steal financial information.

The NCPC offers the following tips for preventing identity theft:

  • Never provide a Social Security number over the Internet or phone.
  • Memorize all passwords, and never store passwords on a computer.
  • When buying items online, always use a credit card for the benefit of being able to dispute bad transactions.
  • Do not use an ATM when someone is within close range.
  • Beware of sites that offer free giveaways and prizes, and do not enter financial information on such sites.
  • Take advantage of developer-based browser add-ons and antivirus software to enhance Internet security.
  • Tell children to avoid giving out their address, phone number or Internet-based contact information.
  • Do not let children plan to meet any friends from Internet sites or chat rooms.
  • Avoid posting public photos of family members, a home, a vehicle or other identifying information on the Internet.
  • Be sure that Internet access at a child’s school is controlled by teachers or other designated responsible adults.

The NCPC offers additional tips, information and statistics on their site. If all Americans work together to prevent identity theft, millions of incidents can be prevented. Another important step for adults to take is to check their credit history every year. Each American adult is entitled to a free credit report copy, which is obtained at AnnualCreditReport.com. This is the only site approved by federal authorities for obtaining a free copy. View the report to look for any account, address and employment discrepancies, and dispute them if there are any. Suspicious accounts may be a sign that someone has stolen personal information and is misappropriating it.

Also, be aware of any odd-looking devices on ATMs, gas pumps and other places where cards are swiped. Thieves place logging devices that detach from these places. If a piece detaches or looks suspicious, report it to the establishment immediately. How Workers’ Comp Experience Rating can Save you Money

How does safety pay dividends to the business owner? Time and resources spent on developing a culture of safety repays the business in the long run. Safety cultures rely on reducing the number of workers compensation claims, in return, the odds of a disastrous claim are reduced.

Business owners with workers’ compensation experience modifications above 1.25 need to review their safety policies with professionals. It is possible one year or even one claim causes this situation; but it should not be ignored. Discover and repair the root cause.

A 1.01 to 1.25 modification indicates worse than average experience. State rates can be less than adequate for a short period of time. The actuarial or mathematical calculations just incorrectly reflect the average expected claims. Slightly elevated modifications may be caused by these issues; however, review your losses by department in these cases and see if a problem area exists.

For slightly elevated modifications, review the safety program and types of losses. Seek out a professional risk manager for help if needed. Look for patterns in the losses, and consider changes in safety equipment or procedures to reduce problem issues.

Proactively nurturing a safety culture will pay long-term dividends. Experience modifications will decrease with positive results. How?

Each state calculates workers’ compensation experience modifications independently. Many states do utilize the services of the National Council on Compensation Insurance (NCCI) to gather data and promulgate base rates and experience modifications; but each state regulates its own workers’ compensation system.

Workers’ compensation experience rating predicts future behavior by analyzing past performance. It is a consequence of loss control performance, neither a reward for no losses nor a punishment for too many claims.

The generic formula for experience modifications follows some rules:

Just as payrolls are the basis for the standard premium, they form the basis for expected claims. Payroll is multiplied by an average claim factor to produce total expected claims.A discount factor is then applied to predict the potential severity of the claims.The product of this equation is expected losses.Actual medical only (MO) claims combine and report as a number of claims/total amount. Some states designate the MO claims as primary (maximum average) and excess, and then apply a discount rate to one or both of these amounts.Most states set a limit on the value of any one claim, and then discount large claims on a sliding scale.This historical claim experience is divided by expected losses. That quotient is the experience modification.

The insurance industry spends millions of dollars to find ways to predict the future. Loss analysts discovered one important fact: the best predictor of future claims is the frequency with which companies suffer losses in the past.

Frequency reflects the number of claims per employee, usually expressed as claims per payroll unit ($100), claims per year, or claims per time unit. Frequency, however, more importantly, reflects the safety culture of the business.

If the frequency of claims is predictable, how about the severity of an individual loss? No, severity, the magnitude of the loss, is not predictable. With greater frequency, however, comes greater odds that a severe claim will occur.

Experience modifications indicate the status of the safety culture within a business. Good management listens to risk management and loss control experts who ultimately reduce workers’ compensation costs.

Here are Some Unwritten Truths About Liability and Workers Compensation Policies and The Insurance Industry

1. Your liability and workers compensation auditors work for your insurance company, not you!  There’s a lot they aren’t telling you which can cost thousands, tens of thousands of dollars. 

2. Is your liability policy preventing you from getting jobs?  Lots of contractors are unaware of how bad their liability policy’s are.  There are brokers selling these policies and in our opinion they are doing an incredible disservice to the construction industry.  How many of you work with general contractors, owners?  Are they asking you to sign contracts?  Do you know if your policy covers what they require in their contract?  Let’s face it most insurance companies do not want to pay claims and their policies are designed to do just that.  Is your policy one of the real lousy ones?   

3. Quite a few New York contractors have liability policies that are inexpensive but their insurance company has a very low financial rating, Labor Law exclusions, no contractual liability, the company is Black Listed.  Then there is the other extreme, liability policy’s that have exclusions acceptable to customers but are outrageously expensive.   How would you like a liability policy that has limited exclusions and good pricing?  With 50 companies we think we can find you one.   

4. It is our opinion there are workers compensation companies that insure a lot of contractors and they do everything possible to charge you as much as they can.   Instead of doing what is in the customer’s best interest they do what is in their best interest. We have better options for you.

5. Why should a customer dislike the company they’re with?  Why when they need help they get tortured?  When they call they don’t get a return call?  When they have a problem no one seems to want to help?   It shouldn’t be this way right? 

6. You really are not going to like hearing this!  Most agency people are limited in what they know (they are so poorly trained it’s a disgrace).  They do not know the ins and outs of the liability or the worker’s compensation system.  They do not know about special credits, rating structures, experience modification factors, payroll rules, how to properly classify payrolls, etc.  And this goes for all areas of coverage: Liability, Umbrella Liability, Business Auto, Bonds, Group Health, etc. 

7. Most insurance agency customer service people are paper pushers.  They have so much work they do not have time to properly check your liability and worker’s compensation policies.  Yes they are pleasant but they miss a lot of what it takes to properly service your account.                                                                                                                                                    

8. BEWARE!!!  If you have your workers compensation through a state or assigned risk program and you operate in other states you are exposed to a HUGE financial liability which may NOT be covered!   Most of you are not aware of this liability but one claim and you can be knocked out of business!   If you are in a state or assigned risk program and operate outside your state we STRONGLY RECOMMEND you look into this matter.

1. For contractors we have 50 liability insurance and 12 workers compensation companies to choose from.  More options mean better pricing and coverage!               

 2.  Regarding General Liability and Umbrella Liability we have companies that have less restrictive exclusions than others.   It is so critical you deal with an insurance broker who is a specialist, who understands the exclusions rather than a generalist.  Believe us most agencies even though they know more than you they still do not know what they’re doing.  We do not like to knock others but a lot of brokers and customer service personnel do not know what they are doing.         

3. How would you like to get away from annual workers compensation audits?  Would you like to set up your policy from the start so you don’t overpay?   How about not owing large additional amounts at the end of your policy period?

Two of our companies allow you to take back control of payroll reporting.  So many contractors, on audit, are overpaying thousands, tens of thousands of dollars because their company is keeping important information from them.   From the beginning, we eliminate this problem.

We DO NOT charge 10% service fees or separate $500 to $2,500 policy fees.  How agencies come up with these fees is baffling.  Actually it’s not.  It’s called greed.  We are that “Diamond in the Rough!”  We don’t do this to our customers (unless we have to insure you through NYS program…they do not pay us a commission.)
